55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the assignment to a trial court of a judge or justice
88 who was defeated in a primary or general election.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 74.053(d), Government Code, is amended
1111 to read as follows:
1212 (d) An assigned judge or justice who was defeated in the
1313 last primary or general election for which the judge or justice was
1414 a candidate for the judicial office held by the judge or justice may
1515 not sit in a criminal or civil case if either party objects to the
1616 judge or justice.
1717 SECTION 2. The change in law made by this Act applies only
1818 to the assignment of a judge or justice made on or after the
1919 effective date of this Act. An assignment made before the effective
2020 date of this Act is governed by the law in effect immediately before
2121 that date, and the former law is continued in effect for that
2222 purpose.
2323 SECTION 3. This Act takes effect September 1, 2015.
