9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 74.053(d), Government Code, is amended | |
11 | 11 | to read as follows: | |
12 | 12 | (d) An assigned judge or justice who was defeated in the | |
13 | 13 | last primary or general election for which the judge or justice was | |
14 | 14 | a candidate for the judicial office held by the judge or justice may | |
15 | 15 | not sit in a criminal or civil case if either party objects to the | |
16 | 16 | judge or justice. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to the assignment of a judge or justice made on or after the | |
19 | 19 | effective date of this Act. An assignment made before the effective | |
20 | 20 | date of this Act is governed by the law in effect immediately before | |
21 | 21 | that date, and the former law is continued in effect for that | |
22 | 22 | purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2015. |
