66 AN ACT
77 relating to state agency authority to establish child-care subsidy
88 programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter E, Chapter 659, Government Code, is
1111 amended by adding Section 659.062 to read as follows:
1212 Sec. 659.062. CHILD-CARE SUBSIDY PROGRAM. (a) A state
1313 agency using money appropriated to the agency by this state may
1414 establish a child-care subsidy program to assist the agency's
1515 low-income employees with their child-care costs. The assistance
1616 may be provided for full-time and part-time child care,
1717 before-school and after-school programs, and daytime summer
1818 programs.
1919 (b) Two or more state agencies in a multitenant building may
2020 establish a child-care subsidy program and share the program costs
2121 to provide employees of the agencies with child-care services
2222 through a child-care facility located in the building.
2323 (c) Except as prohibited under Subsection (d), a state
2424 agency may impose restrictions on the use of appropriated money for
2525 its child-care subsidy program based on employees' needs, the
2626 agency's staffing requirements, the local availability of child
2727 care, and other factors determined by the agency, including
2828 eligibility restrictions based on an employee's:
2929 (1) full-time or part-time employment status;
3030 (2) use of an on-site child-care facility;
3131 (3) use of full-time child care; or
3232 (4) use of child care in limited locations.
3333 (d) A state agency that establishes a child-care subsidy
3434 program under this section may not limit the payment of subsidies to
3535 only child-care facilities licensed by this state under Chapter 42,
3636 Human Resources Code.
3737 (e) Subject to any restriction established under Subsection
3838 (c), an employee who qualifies as a low-income employee under a
3939 state agency's child-care subsidy program is eligible to receive a
4040 child-care subsidy for the care of each child under age 13 or, for a
4141 child with a disability, under age 18.
4242 SECTION 2. This Act takes effect September 1, 2015.
