88 AN ACT
99 relating to the languages in which certain labor and employment
1010 notices and forms must be provided.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 61, Labor Code, is amended
1313 by adding Section 61.006 to read as follows:
1414 Sec. 61.006. NOTICE LANGUAGES. The commission shall:
1515 (1) make available any notice the commission is
1616 required to provide to an employee under this chapter in the two
1717 languages that are most commonly spoken in this state; and
1818 (2) ensure that employees are notified of an
1919 employee's ability to request from the commission notice in either
2020 language described by Subdivision (1).
2121 SECTION 2. Section 61.051, Labor Code, is amended by adding
2222 Subsection (e) to read as follows:
2323 (e) The commission shall ensure that employees are notified
2424 of an employee's ability to request from the commission a wage claim
2525 form in either language described by Section 61.006.
2626 SECTION 3. Subchapter C, Chapter 401, Labor Code, is
2727 amended by adding Section 401.026 to read as follows:
2828 Sec. 401.026. EMPLOYEE NOTICE LANGUAGES. The division
2929 shall make available to an injured employee any notice the division
3030 is required to provide to an injured employee under this subtitle in
3131 the two languages that are most commonly spoken in this state. For
3232 the purpose of this section, notice does not include:
3333 (1) an agreement, award, report, or decision under
3434 Chapter 410;
3535 (2) a commissioner order under this subtitle,
3636 including an order under Chapter 408, 410, or 413;
3737 (3) a matter involving an administrative violation
3838 proceeding under Chapter 415; or
3939 (4) a proceeding or activity under Chapter 2001,
4040 Government Code.
4141 SECTION 4. This Act takes effect September 1, 2015.
