| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 11 | 11 | | is amended by adding Section 201.623 to read as follows: |

| 12 | 12 | | Sec. 201.623. CONSTRUCTION OF DETENTION PONDS. In the |
|---|
| 13 | 13 | | construction of detention ponds associated with its highway |
|---|
| 14 | 14 | | projects, the department shall consider: |
|---|
| 15 | 15 | | (1) using a permeable surface for the detention pond; |
|---|
| 16 | 16 | | or |
|---|
| 17 | 17 | | (2) completing the detention pond so that the pond's |
|---|
| 18 | 18 | | completed state enables it to be used as green space available for |
|---|
| 19 | 19 | | wildlife and the general public. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect September 1, 2015. |
