1010 relating to the punishment for certain offenses against property or
1111 against public administration.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 28.03(b), (f), (h), and (j), Penal
1414 Code, are amended to read as follows:
1515 (b) Except as provided by Subsections (f) and (h), an
1616 offense under this section is:
1717 (1) a Class C misdemeanor if:
1818 (A) the amount of pecuniary loss is less than
1919 $100 [$50]; or
2020 (B) except as provided in Subdivision (3)(A) or
2121 (3)(B), it causes substantial inconvenience to others;
2222 (2) a Class B misdemeanor if the amount of pecuniary
2323 loss is $100 [$50] or more but less than $750 [$500];
2424 (3) a Class A misdemeanor if:
2525 (A) the amount of pecuniary loss is $750 [$500]
2626 or more but less than $2,500 [$1,500]; or
2727 (B) the actor causes in whole or in part
2828 impairment or interruption of any public water supply, or causes to
2929 be diverted in whole, in part, or in any manner, including
3030 installation or removal of any device for any such purpose, any
3131 public water supply, regardless of the amount of the pecuniary
3232 loss;
3333 (4) a state jail felony if the amount of pecuniary loss
3434 is:
3535 (A) $2,500 [$1,500] or more but less than $30,000
3636 [$20,000];
3737 (B) less than $2,500 [$1,500], if the property
3838 damaged or destroyed is a habitation and if the damage or
3939 destruction is caused by a firearm or explosive weapon;
4040 (C) less than $2,500 [$1,500], if the property
4141 was a fence used for the production or containment of:
4242 (i) cattle, bison, horses, sheep, swine,
4343 goats, exotic livestock, or exotic poultry; or
4444 (ii) game animals as that term is defined by
4545 Section 63.001, Parks and Wildlife Code; or
4646 (D) less than $30,000 [$20,000] and the actor
4747 causes wholly or partly impairment or interruption of public
4848 communications, public transportation, public gas or power supply,
4949 or other public service, or causes to be diverted wholly, partly, or
5050 in any manner, including installation or removal of any device for
5151 any such purpose, any public communications or public gas or power
5252 supply;
5353 (5) a felony of the third degree if the amount of the
5454 pecuniary loss is $30,000 [$20,000] or more but less than $150,000
5555 [$100,000];
5656 (6) a felony of the second degree if the amount of
5757 pecuniary loss is $150,000 [$100,000] or more but less than
5858 $300,000 [$200,000]; or
5959 (7) a felony of the first degree if the amount of
6060 pecuniary loss is $300,000 [$200,000] or more.
6161 (f) An offense under this section is a state jail felony if
6262 the damage or destruction is inflicted on a place of worship or
6363 human burial, a public monument, or a community center that
6464 provides medical, social, or educational programs and the amount of
6565 the pecuniary loss to real property or to tangible personal
6666 property is $750 or more but less than $30,000 [$20,000].
6767 (h) An offense under this section is a state jail felony if
6868 the amount of the pecuniary loss to real property or to tangible
6969 personal property is $750 [$1,500] or more but less than $30,000
7070 [$20,000] and the damage or destruction is inflicted on a public or
7171 private elementary school, secondary school, or institution of
7272 higher education.
7373 (j) Notwithstanding Subsection (b), an offense under this
7474 section is a felony of the third degree if:
7575 (1) the tangible property damaged, destroyed, or
7676 tampered with is transportation communications equipment or a
7777 transportation communications device; and
7878 (2) the amount of the pecuniary loss to the tangible
7979 property is less than $150,000 [$100,000].
8080 SECTION 2. Section 28.06(d), Penal Code, is amended to read
8181 as follows:
8282 (d) If the amount of pecuniary loss cannot be ascertained by
8383 the criteria set forth in Subsections (a) through (c), the amount of
8484 loss is deemed to be greater than $750 [$500] but less than $2,500
8585 [$1,500].
8686 SECTION 3. Section 28.07(e), Penal Code, is amended to read
8787 as follows:
8888 (e) An offense under Subsection (b)(2)(B), (b)(2)(C), or
8989 (b)(2)(D) is a Class C misdemeanor unless the person causes
9090 pecuniary loss of $100 or more, in which event the offense is:
9191 (1) a Class B misdemeanor if the amount of pecuniary
9292 loss is $100 [$20] or more but less than $750 [$500];
9393 (2) a Class A misdemeanor if the amount of pecuniary
9494 loss is $750 [$500] or more but less than $2,500 [$1,500];
9595 (3) a state jail felony if the amount of pecuniary loss
9696 is $2,500 [$1,500] or more but less than $30,000 [$20,000];
9797 (4) a felony of the third degree if the amount of the
9898 pecuniary loss is $30,000 [$20,000] or more but less than $150,000
9999 [$100,000];
100100 (5) a felony of the second degree if the amount of
101101 pecuniary loss is $150,000 [$100,000] or more but less than
102102 $300,000 [$200,000]; or
103103 (6) a felony of the first degree if the amount of the
104104 pecuniary loss is $300,000 [$200,000] or more.
105105 SECTION 4. Sections 28.08(b) and (d), Penal Code, are
106106 amended to read as follows:
107107 (b) Except as provided by Subsection (d), an offense under
108108 this section is:
109109 (1) a Class C misdemeanor if the amount of pecuniary
110110 loss is less than $100;
111111 (2) a Class B misdemeanor if the amount of pecuniary
112112 loss is $100 or more but less than $750 [$500];
113113 (3) [(2)] a Class A misdemeanor if the amount of
114114 pecuniary loss is $750 [$500] or more but less than $2,500 [$1,500];
115115 (4) [(3)] a state jail felony if the amount of
116116 pecuniary loss is $2,500 [$1,500] or more but less than $30,000
117117 [$20,000];
118118 (5) [(4)] a felony of the third degree if the amount of
119119 pecuniary loss is $30,000 [$20,000] or more but less than $150,000
120120 [$100,000];
121121 (6) [(5)] a felony of the second degree if the amount
122122 of pecuniary loss is $150,000 [$100,000] or more but less than
123123 $300,000 [$200,000]; or
124124 (7) [(6)] a felony of the first degree if the amount of
125125 pecuniary loss is $300,000 [$200,000] or more.
126126 (d) An offense under this section is a state jail felony if:
127127 (1) the marking is made on a school, an institution of
128128 higher education, a place of worship or human burial, a public
129129 monument, or a community center that provides medical, social, or
130130 educational programs; and
131131 (2) the amount of the pecuniary loss to real property
132132 or to tangible personal property is $750 or more but less than
133133 $30,000 [$20,000].
134134 SECTION 5. Article 14.06(d), Code of Criminal Procedure, is
135135 amended to read as follows:
136136 (d) Subsection (c) applies only to a person charged with
137137 committing an offense under:
138138 (1) Section 481.121, Health and Safety Code, if the
139139 offense is punishable under Subsection (b)(1) or (2) of that
140140 section;
141141 (1-a) Section 481.1161, Health and Safety Code, if the
142142 offense is punishable under Subsection (b)(1) or (2) of that
143143 section;
144144 (2) Section 28.03, Penal Code, if the offense is
145145 punishable under Subsection (b)(2) of that section;
146146 (3) Section 28.08, Penal Code, if the offense is
147147 punishable under Subsection (b)(2) or (3) [(b)(1)] of that section;
148148 (4) Section 31.03, Penal Code, if the offense is
149149 punishable under Subsection (e)(2)(A) of that section;
150150 (5) Section 31.04, Penal Code, if the offense is
151151 punishable under Subsection (e)(2) of that section;
152152 (6) Section 38.114, Penal Code, if the offense is
153153 punishable as a Class B misdemeanor; or
154154 (7) Section 521.457, Transportation Code.
155155 SECTION 6. Section 31.03(e), Penal Code, is amended to read
156156 as follows:
157157 (e) Except as provided by Subsection (f), an offense under
158158 this section is:
159159 (1) a Class C misdemeanor if the value of the property
160160 stolen is less than $100[:
161161 [(A) $50; or
162162 [(B) $20 and the defendant obtained the property
163163 by issuing or passing a check or similar sight order in a manner
164164 described by Section 31.06];
165165 (2) a Class B misdemeanor if:
166166 (A) the value of the property stolen is $100[:
167167 [(i) $50] or more but less than $750 [$500;
168168 or
169169 [(ii) $20 or more but less than $500 and the
170170 defendant obtained the property by issuing or passing a check or
171171 similar sight order in a manner described by Section 31.06];
172172 (B) the value of the property stolen is less than
173173 $100[:
174174 [(i) $50] and the defendant has previously
175175 been convicted of any grade of theft; or
176176 [(ii) $20, the defendant has previously
177177 been convicted of any grade of theft, and the defendant obtained the
178178 property by issuing or passing a check or similar sight order in a
179179 manner described by Section 31.06; or]
180180 (C) the property stolen is a driver's license,
181181 commercial driver's license, or personal identification
182182 certificate issued by this state or another state;
183183 (3) a Class A misdemeanor if the value of the property
184184 stolen is $750 [$500] or more but less than $2,500 [$1,500];
185185 (4) a state jail felony if:
186186 (A) the value of the property stolen is $2,500
187187 [$1,500] or more but less than $30,000 [$20,000], or the property is
188188 less than 10 head of sheep, swine, or goats or any part thereof
189189 under the value of $30,000 [$20,000];
190190 (B) regardless of value, the property is stolen
191191 from the person of another or from a human corpse or grave,
192192 including property that is a military grave marker;
193193 (C) the property stolen is a firearm, as defined
194194 by Section 46.01;
195195 (D) the value of the property stolen is less than
196196 $2,500 [$1,500] and the defendant has been previously convicted two
197197 or more times of any grade of theft;
198198 (E) the property stolen is an official ballot or
199199 official carrier envelope for an election; or
200200 (F) the value of the property stolen is less than
201201 $30,000 [$20,000] and the property stolen is:
202202 (i) aluminum;
203203 (ii) bronze;
204204 (iii) copper; or
205205 (iv) brass;
206206 (5) a felony of the third degree if the value of the
207207 property stolen is $30,000 [$20,000] or more but less than $150,000
208208 [$100,000], or the property is:
209209 (A) cattle, horses, or exotic livestock or exotic
210210 fowl as defined by Section 142.001, Agriculture Code, stolen during
211211 a single transaction and having an aggregate value of less than
212212 $150,000 [$100,000]; or
213213 (B) 10 or more head of sheep, swine, or goats
214214 stolen during a single transaction and having an aggregate value of
215215 less than $150,000 [$100,000];
216216 (6) a felony of the second degree if:
217217 (A) the value of the property stolen is $150,000
218218 [$100,000] or more but less than $300,000 [$200,000]; or
219219 (B) the value of the property stolen is less than
220220 $300,000 [$200,000] and the property stolen is an automated teller
221221 machine or the contents or components of an automated teller
222222 machine; or
223223 (7) a felony of the first degree if the value of the
224224 property stolen is $300,000 [$200,000] or more.
225225 SECTION 7. Sections 31.04(b) and (e), Penal Code, are
226226 amended to read as follows:
227227 (b) For purposes of this section, intent to avoid payment is
228228 presumed if:
229229 (1) the actor absconded without paying for the service
230230 or expressly refused to pay for the service in circumstances where
231231 payment is ordinarily made immediately upon rendering of the
232232 service, as in hotels, campgrounds, recreational vehicle parks,
233233 restaurants, and comparable establishments;
234234 (2) the actor failed to make payment under a service
235235 agreement within 10 days after receiving notice demanding payment;
236236 (3) the actor returns property held under a rental
237237 agreement after the expiration of the rental agreement and fails to
238238 pay the applicable rental charge for the property within 10 days
239239 after the date on which the actor received notice demanding
240240 payment; or
241241 (4) the actor failed to return the property held under
242242 a rental agreement:
243243 (A) within five days after receiving notice
244244 demanding return, if the property is valued at less than $2,500
245245 [$1,500]; or
246246 (B) within three days after receiving notice
247247 demanding return, if the property is valued at $2,500 [$1,500] or
248248 more.
249249 (e) An offense under this section is:
250250 (1) a Class C misdemeanor if the value of the service
251251 stolen is less than $100 [$20];
252252 (2) a Class B misdemeanor if the value of the service
253253 stolen is $100 [$20] or more but less than $750 [$500];
254254 (3) a Class A misdemeanor if the value of the service
255255 stolen is $750 [$500] or more but less than $2,500 [$1,500];
256256 (4) a state jail felony if the value of the service
257257 stolen is $2,500 [$1,500] or more but less than $30,000 [$20,000];
258258 (5) a felony of the third degree if the value of the
259259 service stolen is $30,000 [$20,000] or more but less than $150,000
260260 [$100,000];
261261 (6) a felony of the second degree if the value of the
262262 service stolen is $150,000 [$100,000] or more but less than
263263 $300,000 [$200,000]; or
264264 (7) a felony of the first degree if the value of the
265265 service stolen is $300,000 [$200,000] or more.
266266 SECTION 8. Section 31.08(c), Penal Code, is amended to read
267267 as follows:
268268 (c) If property or service has value that cannot be
269269 reasonably ascertained by the criteria set forth in Subsections (a)
270270 and (b), the property or service is deemed to have a value of $750
271271 [$500] or more but less than $2,500 [$1,500].
272272 SECTION 9. Sections 31.16(c) and (d), Penal Code, are
273273 amended to read as follows:
274274 (c) An offense under this section is:
275275 (1) a Class C misdemeanor if the total value of the
276276 merchandise involved in the activity is less than $100;
277277 (2) a Class B misdemeanor if the total value of the
278278 merchandise involved in the activity is $100 or more but less than
279279 $750 [$50];
280280 (3) [(2)] a Class A misdemeanor if the total value of
281281 the merchandise involved in the activity is $750 [$50] or more but
282282 less than $2,500 [$500];
283283 (4) [(3)] a state jail felony if the total value of the
284284 merchandise involved in the activity is $2,500 [$500] or more but
285285 less than $30,000 [$1,500];
286286 (5) [(4)] a felony of the third degree if the total
287287 value of the merchandise involved in the activity is $30,000
288288 [$1,500] or more but less than $150,000 [$20,000];
289289 (6) [(5)] a felony of the second degree if the total
290290 value of the merchandise involved in the activity is $150,000
291291 [$20,000] or more but less than $300,000 [$100,000]; or
292292 (7) [(6)] a felony of the first degree if the total
293293 value of the merchandise involved in the activity is $300,000
294294 [$100,000] or more.
295295 (d) An offense described for purposes of punishment by
296296 Subsections (c)(1)-(6) [(c)(1)-(5)] is increased to the next higher
297297 category of offense if it is shown on the trial of the offense that:
298298 (1) the person organized, supervised, financed, or
299299 managed one or more other persons engaged in an activity described
300300 by Subsection (b); or
301301 (2) during the commission of the offense, a person
302302 engaged in an activity described by Subsection (b) intentionally,
303303 knowingly, or recklessly:
304304 (A) caused a fire exit alarm to sound or
305305 otherwise become activated;
306306 (B) deactivated or otherwise prevented a fire
307307 exit alarm or retail theft detector from sounding; or
308308 (C) used a shielding or deactivation instrument
309309 to prevent or attempt to prevent detection of the offense by a
310310 retail theft detector.
311311 SECTION 10. Section 32.02(c), Penal Code, is amended to
312312 read as follows:
313313 (c) If property or service has value that cannot be
314314 reasonably ascertained by the criteria set forth in Subsections (a)
315315 and (b), the property or service is deemed to have a value of $750
316316 [$500] or more but less than $2,500 [$1,500].
317317 SECTION 11. Section 32.23(e), Penal Code, is amended to
318318 read as follows:
319319 (e) An offense under this section is a:
320320 (1) Class C misdemeanor if the retail value of the item
321321 or service is less than $100 [$20];
322322 (2) Class B misdemeanor if the retail value of the item
323323 or service is $100 [$20] or more but less than $750 [$500];
324324 (3) Class A misdemeanor if the retail value of the item
325325 or service is $750 [$500] or more but less than $2,500 [$1,500];
326326 (4) state jail felony if the retail value of the item
327327 or service is $2,500 [$1,500] or more but less than $30,000

329329 (5) felony of the third degree if the retail value of

366366 destroyed, removed, concealed, encumbered, or otherwise harmed or
367367 reduced in value is $100 [$20] or more but less than $750 [$500];
368368 (3) Class A misdemeanor if the value of the property
369369 destroyed, removed, concealed, encumbered, or otherwise harmed or
370370 reduced in value is $750 [$500] or more but less than $2,500
371371 [$1,500];
372372 (4) state jail felony if the value of the property
373373 destroyed, removed, concealed, encumbered, or otherwise harmed or
374374 reduced in value is $2,500 [$1,500] or more but less than $30,000
375375 [$20,000];
376376 (5) felony of the third degree if the value of the
377377 property destroyed, removed, concealed, encumbered, or otherwise

386386 harmed or reduced in value is $300,000 [$200,000] or more.
387387 (e) A person who is a debtor under a security agreement, and
388388 who does not have a right to sell or dispose of the secured property
389389 or is required to account to the secured party for the proceeds of a
390390 permitted sale or disposition, commits an offense if the person
391391 sells or otherwise disposes of the secured property, or does not
392392 account to the secured party for the proceeds of a sale or other
393393 disposition as required, with intent to appropriate (as defined in
394394 Chapter 31) the proceeds or value of the secured property. A person
395395 is presumed to have intended to appropriate proceeds if the person
396396 does not deliver the proceeds to the secured party or account to the
397397 secured party for the proceeds before the 11th day after the day
398398 that the secured party makes a lawful demand for the proceeds or
399399 account. An offense under this subsection is:
400400 (1) a Class C misdemeanor if the proceeds obtained
401401 from the sale or other disposition are money or goods having a value
402402 of less than $100 [$20];
403403 (2) a Class B misdemeanor if the proceeds obtained
404404 from the sale or other disposition are money or goods having a value
405405 of $100 [$20] or more but less than $750 [$500];
406406 (3) a Class A misdemeanor if the proceeds obtained
407407 from the sale or other disposition are money or goods having a value
408408 of $750 [$500] or more but less than $2,500 [$1,500];
409409 (4) a state jail felony if the proceeds obtained from
410410 the sale or other disposition are money or goods having a value of
411411 $2,500 [$1,500] or more but less than $30,000 [$20,000];
412412 (5) a felony of the third degree if the proceeds
413413 obtained from the sale or other disposition are money or goods
414414 having a value of $30,000 [$20,000] or more but less than $150,000
415415 [$100,000];
416416 (6) a felony of the second degree if the proceeds
417417 obtained from the sale or other disposition are money or goods
418418 having a value of $150,000 [$100,000] or more but less than $300,000
419419 [$200,000]; or
420420 (7) a felony of the first degree if the proceeds
421421 obtained from the sale or other disposition are money or goods
422422 having a value of $300,000 [$200,000] or more.
423423 SECTION 14. Section 32.34(f), Penal Code, is amended to

425425 (f) An offense under Subsection (b)(1), (b)(2), or (b)(3)

427427 (1) a state jail felony if the value of the motor
428428 vehicle is less than $30,000 [$20,000]; [or]
429429 (2) a felony of the third degree if the value of the
430430 motor vehicle is $30,000 [$20,000] or more but less than $150,000;
431431 (3) a felony of the second degree if the value of the
432432 motor vehicle is $150,000 or more but less than $300,000; or
433433 (4) a felony of the first degree if the value of the
434434 motor vehicle is $300,000 or more.
435435 SECTION 15. Section 32.35(e), Penal Code, is amended to
436436 read as follows:
437437 (e) An offense under this section is a:
438438 (1) Class C misdemeanor if the amount of the record of
439439 a sale is less than $100 [$20];
440440 (2) Class B misdemeanor if the amount of the record of
441441 a sale is $100 [$20] or more but less than $750 [$500];
442442 (3) Class A misdemeanor if the amount of the record of
443443 a sale is $750 [$500] or more but less than $2,500 [$1,500];
444444 (4) state jail felony if the amount of the record of a
445445 sale is $2,500 [$1,500] or more but less than $30,000 [$20,000];
446446 (5) felony of the third degree if the amount of the
447447 record of a sale is $30,000 [$20,000] or more but less than $150,000

555555 (A) the value of the telecommunications service
556556 used or diverted is $750 [$500] or more but less than $2,500

558558 (B) the value of the telecommunications service
559559 used or diverted is less than $750 [$500] and the defendant has been
560560 previously convicted of an offense under this chapter;
561561 (4) [(3)] a state jail felony if:
562562 (A) the value of the telecommunications service

653653 services are considered to have a value of $750 [$500] or more but
654654 less than $2,500 [$1,500].
655655 SECTION 25. Section 35A.02(b), Penal Code, is amended to
656656 read as follows:
657657 (b) An offense under this section is:
658658 (1) a Class C misdemeanor if the amount of any payment
659659 or the value of any monetary or in-kind benefit provided or claim
660660 for payment made under the Medicaid program, directly or
661661 indirectly, as a result of the conduct is less than $100 [$50];
662662 (2) a Class B misdemeanor if the amount of any payment
663663 or the value of any monetary or in-kind benefit provided or claim
664664 for payment made under the Medicaid program, directly or
665665 indirectly, as a result of the conduct is $100 [$50] or more but
666666 less than $750 [$500];
667667 (3) a Class A misdemeanor if the amount of any payment
668668 or the value of any monetary or in-kind benefit provided or claim
669669 for payment made under the Medicaid program, directly or
670670 indirectly, as a result of the conduct is $750 [$500] or more but
671671 less than $2,500 [$1,500];
672672 (4) a state jail felony if:
673673 (A) the amount of any payment or the value of any
674674 monetary or in-kind benefit provided or claim for payment made
675675 under the Medicaid program, directly or indirectly, as a result of
676676 the conduct is $2,500 [$1,500] or more but less than $30,000
677677 [$20,000];
678678 (B) the offense is committed under Subsection
679679 (a)(11); or
680680 (C) it is shown on the trial of the offense that
681681 the amount of the payment or value of the benefit described by this
682682 subsection cannot be reasonably ascertained;
683683 (5) a felony of the third degree if:
684684 (A) the amount of any payment or the value of any
685685 monetary or in-kind benefit provided or claim for payment made
686686 under the Medicaid program, directly or indirectly, as a result of
687687 the conduct is $30,000 [$20,000] or more but less than $150,000
688688 [$100,000]; or
689689 (B) it is shown on the trial of the offense that
690690 the defendant submitted more than 25 but fewer than 50 fraudulent
691691 claims under the Medicaid program and the submission of each claim
692692 constitutes conduct prohibited by Subsection (a);
693693 (6) a felony of the second degree if:
694694 (A) the amount of any payment or the value of any
695695 monetary or in-kind benefit provided or claim for payment made
696696 under the Medicaid program, directly or indirectly, as a result of
697697 the conduct is $150,000 [$100,000] or more but less than $300,000
698698 [$200,000]; or
699699 (B) it is shown on the trial of the offense that
700700 the defendant submitted 50 or more fraudulent claims under the
701701 Medicaid program and the submission of each claim constitutes
702702 conduct prohibited by Subsection (a); or
703703 (7) a felony of the first degree if the amount of any
704704 payment or the value of any monetary or in-kind benefit provided or
705705 claim for payment made under the Medicaid program, directly or
706706 indirectly, as a result of the conduct is $300,000 [$200,000] or
707707 more.
708708 SECTION 26. Section 39.02(c), Penal Code, is amended to
709709 read as follows:
710710 (c) An offense under Subsection (a)(2) is:
711711 (1) a Class C misdemeanor if the value of the use of
712712 the thing misused is less than $100 [$20];
713713 (2) a Class B misdemeanor if the value of the use of
714714 the thing misused is $100 [$20] or more but less than $750 [$500];
715715 (3) a Class A misdemeanor if the value of the use of
716716 the thing misused is $750 [$500] or more but less than $2,500
717717 [$1,500];
718718 (4) a state jail felony if the value of the use of the
719719 thing misused is $2,500 [$1,500] or more but less than $30,000
720720 [$20,000];
721721 (5) a felony of the third degree if the value of the
722722 use of the thing misused is $30,000 [$20,000] or more but less than
723723 $150,000 [$100,000];
724724 (6) a felony of the second degree if the value of the
725725 use of the thing misused is $150,000 [$100,000] or more but less
726726 than $300,000 [$200,000]; or
727727 (7) a felony of the first degree if the value of the
728728 use of the thing misused is $300,000 [$200,000] or more.
729729 SECTION 27. The changes in law made by this Act apply only
730730 to an offense committed on or after the effective date of this Act.
731731 An offense committed before the effective date of this Act is
732732 governed by the law in effect on the date the offense was committed,
733733 and the former law is continued in effect for that purpose. For
734734 purposes of this section, an offense was committed before the
735735 effective date of this Act if any element of the offense occurred
736736 before that date.
737737 SECTION 28. This Act takes effect September 1, 2015.
