| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subtitle C, Title 5, Local Government Code, is |
|---|
| 12 | 12 | | amended by adding Chapter 179 to read as follows: |
|---|
| 13 | 13 | | CHAPTER 179. VERIFICATION OF EMPLOYEE INFORMATION |
|---|
| 14 | 14 | | Sec. 179.001. DEFINITIONS. In this chapter: |
|---|
| 15 | 15 | | (1) "E-verify program" means the electronic |
|---|
| 16 | 16 | | verification of employment authorization program of the federal |
|---|
| 17 | 17 | | Illegal Immigration Reform and Immigrant Responsibility Act of 1996 |
|---|
| 18 | 18 | | (Pub. L. No. 104-208, reprinted in note, 8 U.S.C. Section 1324a), |
|---|
| 19 | 19 | | operated by the United States Department of Homeland Security, or a |
|---|
| 20 | 20 | | successor employment authorization program designated by the |
|---|
| 21 | 21 | | United States Department of Homeland Security or other federal |
|---|
| 22 | 22 | | agency authorized to verify the employment authorization status of |
|---|
| 23 | 23 | | newly hired employees under the federal Immigration Reform and |
|---|
| 24 | 24 | | Control Act of 1986 (8 U.S.C. Section 1101 et seq.). |
|---|
| 25 | 25 | | (2) "Political subdivision" means a county, |
|---|
| 26 | 26 | | municipality, school district, junior college district, other |
|---|
| 27 | 27 | | special district, or other subdivision of state government. |
|---|
| 28 | 28 | | Sec. 179.002. VERIFICATION. A political subdivision shall |
|---|
| 29 | 29 | | register and participate in the E-verify program to verify |
|---|
| 30 | 30 | | information of all new employees. |
|---|
| 31 | 31 | | Sec. 179.003. STATE FUNDING PROHIBITED FOR FAILURE TO |
|---|
| 32 | 32 | | PARTICIPATE IN E-VERIFY. Beginning the state fiscal year following |
|---|
| 33 | 33 | | the effective date of this Act, a political subdivision may not |
|---|
| 34 | 34 | | receive state funds if the political subdivision fails to register |
|---|
| 35 | 35 | | and participate in the E-verify program as required by Section |
|---|
| 36 | 36 | | 179.002. A political subdivision denied state funds under this |
|---|
| 37 | 37 | | section may receive state funds beginning the state fiscal year |
|---|
| 38 | 38 | | following the year in which the political subdivision registers and |
|---|
| 39 | 39 | | participates in the E-verify program as required by Section |
|---|
| 40 | 40 | | 179.002. The Governor's Office of Budget, Planning, and Policy |
|---|
| 41 | 41 | | shall adopt rules to implement this section uniformly among state |
|---|
| 42 | 42 | | agencies from which state funds are distributed to a political |
|---|
| 43 | 43 | | subdivision. |

| 44 | 44 | | SECTION 2. This Act takes effect September 1, 2015. |
