66 AN ACT
77 relating to requiring political subdivisions to participate in the
88 federal electronic verification of employment authorization
99 program or E-verify.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle C, Title 5, Local Government Code, is
1212 amended by adding Chapter 179 to read as follows:
1313 CHAPTER 179. VERIFICATION OF EMPLOYEE INFORMATION
1414 Sec. 179.001. DEFINITIONS. In this chapter:
1515 (1) "E-verify program" means the electronic
1616 verification of employment authorization program of the federal
1717 Illegal Immigration Reform and Immigrant Responsibility Act of 1996
1818 (Pub. L. No. 104-208, reprinted in note, 8 U.S.C. Section 1324a),
1919 operated by the United States Department of Homeland Security, or a
2020 successor employment authorization program designated by the
2121 United States Department of Homeland Security or other federal
2222 agency authorized to verify the employment authorization status of
2323 newly hired employees under the federal Immigration Reform and
2424 Control Act of 1986 (8 U.S.C. Section 1101 et seq.).
2525 (2) "Political subdivision" means a county,
2626 municipality, school district, junior college district, other
2727 special district, or other subdivision of state government.
2828 Sec. 179.002. VERIFICATION. A political subdivision shall
2929 register and participate in the E-verify program to verify
3030 information of all new employees.
3131 Sec. 179.003. STATE FUNDING PROHIBITED FOR FAILURE TO
3232 PARTICIPATE IN E-VERIFY. Beginning the state fiscal year following
3333 the effective date of this Act, a political subdivision may not
3434 receive state funds if the political subdivision fails to register
3535 and participate in the E-verify program as required by Section
3636 179.002. A political subdivision denied state funds under this
3737 section may receive state funds beginning the state fiscal year
3838 following the year in which the political subdivision registers and
3939 participates in the E-verify program as required by Section
4040 179.002. The Governor's Office of Budget, Planning, and Policy
4141 shall adopt rules to implement this section uniformly among state
4242 agencies from which state funds are distributed to a political
4343 subdivision.
4444 SECTION 2. This Act takes effect September 1, 2015.
