88 AN ACT
99 relating to creation of a search and rescue task force in each
1010 disaster field response region.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 418.043, Government Code, is amended to
1313 read as follows:
1414 Sec. 418.043. OTHER POWERS AND DUTIES. The division shall:
1515 (1) determine requirements of the state and its
1616 political subdivisions for food, clothing, and other necessities in
1717 event of a disaster;
1818 (2) procure and position supplies, medicines,
1919 materials, and equipment;
2020 (3) adopt standards and requirements for local and
2121 interjurisdictional emergency management plans;
2222 (4) periodically review local and interjurisdictional
2323 emergency management plans;
2424 (5) coordinate deployment of mobile support units;
2525 (6) establish and operate training programs and
2626 programs of public information or assist political subdivisions and
2727 emergency management agencies to establish and operate the
2828 programs;
2929 (7) make surveys of public and private industries,
3030 resources, and facilities in the state that are necessary to carry
3131 out the purposes of this chapter;
3232 (8) plan and make arrangements for the availability
3333 and use of any private facilities, services, and property and
3434 provide for payment for use under terms and conditions agreed on if
3535 the facilities are used and payment is necessary;
3636 (9) establish a register of persons with types of
3737 training and skills important in disaster mitigation,
3838 preparedness, response, and recovery;
3939 (10) establish a register of mobile and construction
4040 equipment and temporary housing available for use in a disaster;
4141 (11) assist political subdivisions in developing
4242 plans for the humane evacuation, transport, and temporary
4343 sheltering of service animals and household pets in a disaster;
4444 (12) prepare, for issuance by the governor, executive
4545 orders and regulations necessary or appropriate in coping with
4646 disasters;
4747 (13) cooperate with the federal government and any
4848 public or private agency or entity in achieving any purpose of this
4949 chapter and in implementing programs for disaster mitigation,
5050 preparation, response, and recovery;
5151 (14) develop a plan to raise public awareness and
5252 expand the capability of the information and referral network under
5353 Section 531.0312;
5454 (15) improve the integration of volunteer groups,
5555 including faith-based organizations, into emergency management
5656 plans;
5757 (16) cooperate with the Federal Emergency Management
5858 Agency to create uniform guidelines for acceptable home repairs
5959 following disasters and promote public awareness of the guidelines;
6060 (17) cooperate with state agencies to:
6161 (A) encourage the public to participate in
6262 volunteer emergency response teams and organizations that respond
6363 to disasters; and
6464 (B) provide information on those programs in
6565 state disaster preparedness and educational materials and on
6666 Internet websites;
6767 (18) establish a liability awareness program for
6868 volunteers, including medical professionals;
6969 (19) define "individuals with special needs" in the
7070 context of a disaster;
7171 (20) establish and operate, subject to the
7272 availability of funds, a search and rescue task force in each field
7373 response region established by the division to assist in search,
7474 rescue, and recovery efforts before, during, and after a natural or
7575 man-made disaster; and
7676 (21) [(20)] do other things necessary, incidental, or
7777 appropriate for the implementation of this chapter.
7878 SECTION 2. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2015.
