55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the procedures for registering to vote.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 13.002, Election Code, is amended by
1010 amending Subsection (c) and adding Subsection (j) to read as
1111 follows:
1212 (c) A registration application must include:
1313 (1) the applicant's first name, middle name, if any,
1414 last name, and former name, if any;
1515 (2) the month, day, and year of the applicant's birth;
1616 (3) a statement that the applicant is a United States
1717 citizen;
1818 (4) a statement that the applicant is a resident of the
1919 county;
2020 (5) a statement that the applicant has not been
2121 determined by a final judgment of a court exercising probate
2222 jurisdiction to be:
2323 (A) totally mentally incapacitated; or
2424 (B) partially mentally incapacitated without the
2525 right to vote;
2626 (6) a statement that the applicant has not been
2727 finally convicted of a felony or that the applicant is a felon
2828 eligible for registration under Section 13.001;
2929 (7) the applicant's residence address or, if the
3030 residence has no address, the address at which the applicant
3131 receives mail and a concise description of the location of the
3232 applicant's residence;
3333 (8) the following information:
3434 (A) the applicant's Texas driver's license number
3535 or the number of a personal identification card issued by the
3636 Department of Public Safety;
3737 (B) if the applicant has not been issued a number
3838 described by Paragraph (A), the last four digits of the applicant's
3939 social security number; or
4040 (C) a statement by the applicant that the
4141 applicant has not been issued a number described by Paragraph (A) or
4242 (B);
4343 (9) if the application is made by an agent, a statement
4444 of the agent's relationship to the applicant; [and]
4545 (10) the city and county in which the applicant
4646 formerly resided; and
4747 (11) a certified copy of a document providing proof
4848 that the applicant is a United States citizen.
4949 (j) The following documentation is acceptable as proof of
5050 citizenship under Subsection (c)(11):
5151 (1) a birth certificate or other document confirming
5252 birth as a citizen of the United States that is admissible in a
5353 court of law;
5454 (2) United States citizenship documents issued to the
5555 applicant;
5656 (3) a United States passport issued to the applicant;
5757 (4) a Bureau of Indian Affairs card number, tribal
5858 treaty number, or tribal enrollment number issued to the applicant;
5959 or
6060 (5) a United States military record of service
6161 indicating the applicant's name and the applicant's place of birth
6262 within the United States.
6363 SECTION 2. Section 13.071(a), Election Code, is amended to
6464 read as follows:
6565 (a) The registrar shall review each submitted application
6666 for registration to determine whether it complies with Section
6767 13.002 and indicates that the applicant is a United States citizen
6868 eligible for registration.
6969 SECTION 3. Section 13.072(a), Election Code, is amended to
7070 read as follows:
7171 (a) Unless the registrar challenges the applicant, the
7272 registrar shall approve the application if:
7373 (1) the registrar determines that an application
7474 complies with Section 13.002 and indicates that the applicant is a
7575 United States citizen eligible for registration; and
7676 (2) for an applicant who has not included a statement
7777 described by Section 13.002(c)(8)(C), the registrar verifies with
7878 the secretary of state:
7979 (A) the applicant's Texas driver's license number
8080 or number of a personal identification card issued by the
8181 Department of Public Safety; or
8282 (B) the last four digits of the applicant's
8383 social security number.
8484 SECTION 4. Section 13.121(a), Election Code, is amended to
8585 read as follows:
8686 (a) The officially prescribed application form for
8787 registration by mail must be in the form of [a] business reply mail
8888 [postcard], unless another form or system is used under Subsection
8989 (b), with postage paid by the state. The secretary of state shall
9090 design the form to enhance the legibility of its contents.
9191 SECTION 5. The changes in law made by this Act apply only to
9292 an application to register to vote submitted on or after the
9393 effective date of this Act.
9494 SECTION 6. This Act takes effect September 1, 2015.
