55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to conditions of bond for defendants charged with certain
88 offenses involving the operation of a motor vehicle while
99 intoxicated.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 17, Code of Criminal Procedure, is
1212 amended by adding Article 17.442 to read as follows:
1313 Art. 17.442. CONDITION FOR DEFENDANT CHARGED WITH DRIVING
1414 WHILE INTOXICATED. (a) This article applies to a defendant
1515 charged with an offense under:
1616 (1) Section 49.04 or 49.045, Penal Code; or
1717 (2) Section 49.07 or 49.08, Penal Code, involving the
1818 operation of a motor vehicle while intoxicated.
1919 (b) A magistrate may require as a condition of release on
2020 bond that a defendant to whom this article applies refrain from
2121 operating a motor vehicle in any public place pending the
2222 conclusion of criminal proceedings against the defendant for an
2323 offense described by Subsection (a).
2424 (c) The magistrate may revoke the bond and order the
2525 defendant arrested if the defendant violates the condition imposed
2626 under this article.
2727 SECTION 2. The change in law made by this Act applies only
2828 to a defendant released on bond in connection with an offense
2929 committed on or after the effective date of this Act. A defendant
3030 released on bond in connection with an offense committed before the
3131 effective date of this Act is governed by the law in effect on the
3232 date the offense was committed, and the former law is continued in
3333 effect for that purpose. For purposes of this section, an offense
3434 was committed before the effective date of this Act if any element
3535 of the offense occurred before that date.
3636 SECTION 3. This Act takes effect September 1, 2015.
