| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 30.02(c), Penal Code, is amended to read | |
| 10 | 10 | as follows: | |
| 11 | 11 | (c) Except as provided in Subsection (d), an offense under | |
| 12 | 12 | this section is a: | |
| 13 | 13 | (1) felony of the third degree [state jail felony] if | |
| 14 | 14 | committed in a building other than a habitation; or | |
| 15 | 15 | (2) felony of the second degree if committed in a | |
| 16 | 16 | habitation. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to an offense committed on or after the effective date of this Act. | |
| 19 | 19 | An offense committed before the effective date of this Act is | |
| 20 | 20 | governed by the law in effect when the offense was committed, and | |
| 21 | 21 | the former law is continued in effect for that purpose. For purposes | |
| 22 | 22 | of this section, an offense was committed before the effective date | |
| 23 | 23 | of this Act if any element of the offense occurred before that date. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2015. |
