55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to safety and security policies and procedures in the
88 Capitol Complex.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.062, Government Code, is amended by
1111 adding Subsection (h) to read as follows:
1212 (h) In implementing rules adopted under Subsection (d) and
1313 in imposing measures under Subsection (g), the department shall
1414 develop written policies and procedures relating to the safety and
1515 security of individuals and to the access to and protection of the
1616 grounds and property in the Capitol Complex to ensure that the
1717 policies and procedures are applied consistently and equally to all
1818 individuals in the Capitol Complex. The department may not
1919 implement the policies and procedures, or any modification to the
2020 policies and procedures, until the department electronically or
2121 physically distributes the policies and procedures to:
2222 (1) all department personnel assigned to the Capitol
2323 Complex; and
2424 (2) all state officers and employees whose assigned
2525 place of employment is in the Capitol Complex.
2626 SECTION 2. (a) Not later than December 1, 2015, the
2727 Department of Public Safety shall develop and distribute the
2828 written policies and procedures as required by Section 411.062(h),
2929 Government Code, as added by this Act.
3030 (b) Section 411.062(h), Government Code, as added by this
3131 Act, does not prohibit the department from continuing to enforce
3232 policies and procedures that were in effect on the effective date of
3333 this Act until the time those policies and procedures or their
3434 modifications are distributed, as required by Section 411.062(h),
3535 Government Code, as added by this Act, and Subsection (a) of this
3636 section.
3737 SECTION 3. This Act takes effect September 1, 2015.
