| 7 | 7 | | relating to the duty of a water supply system to provide certain |

| 8 | 8 | | information to consumers regarding fluoride in drinking water. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 341, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 341.0335 to read as follows: |
|---|
| 12 | 12 | | Sec. 341.0335. FLUORIDATED WATER; DISCLOSURE OF CERTAIN |
|---|
| 13 | 13 | | INFORMATION. (a) Except as provided in Subsection (b), a water |
|---|
| 14 | 14 | | supply system that furnishes drinking water to which fluoride has |
|---|
| 15 | 15 | | been added shall disclose in a conspicuous place on the system's |
|---|
| 16 | 16 | | website: |
|---|
| 17 | 17 | | (1) the amount of fluoride that occurs naturally in |
|---|
| 18 | 18 | | the drinking water furnished by the system to a customer; |
|---|
| 19 | 19 | | (2) the amount of fluoride added to the drinking water |
|---|
| 20 | 20 | | before distribution to a customer; |
|---|
| 21 | 21 | | (3) the combined amount of fluoride in the drinking |
|---|
| 22 | 22 | | water from the sources described by Subdivisions (1) and (2); |
|---|
| 23 | 23 | | (4) as applicable, the identity of: |
|---|
| 24 | 24 | | (A) the person who supplies the fluoride |
|---|
| 25 | 25 | | additive; and |
|---|
| 26 | 26 | | (B) the person with whom the system contracts to |
|---|
| 27 | 27 | | add fluoride to the drinking water; and |
|---|
| 28 | 28 | | (5) the annual cost of adding fluoride to the drinking |
|---|
| 29 | 29 | | water distributed by the system, including the cost of the fluoride |
|---|
| 30 | 30 | | additive, the labor for adding the fluoride, and any contracts |
|---|
| 31 | 31 | | related to the fluoride additive. |
|---|
| 32 | 32 | | (b) A water supply system that does not maintain a website |
|---|
| 33 | 33 | | shall disclose annually the information required under Subsection |
|---|
| 34 | 34 | | (a) with a bill sent to its customers. |
|---|
| 35 | 35 | | SECTION 2. A water supply system shall disclose the |
|---|
| 36 | 36 | | information required by Section 341.0335, Health and Safety Code, |
|---|
| 37 | 37 | | as added by this Act, not later than January 1, 2016. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2015. |
