The bill would amend the Property Code to permit a condominium owner to bring an action in district court seeking a determination that the timeshare interest claimed by another individual is invalid or void under certain circumstances. The bill would prescribe procedures for a condominium owner to file an action and procedures for the determination of the court. Under the provisions of the bill, the court would be permitted to enter a default judgment and permit a condominium owner to file a motion for a new trial on or before the 30th day after the judgment is signed.The Office of Court Administration reported no significant fiscal impact to the local court is anticipated.
