The bill would amend the Property Code to permit a condominium owner to bring an action in district court seeking a determination that the timeshare interest claimed by another individual is invalid or void under certain circumstances. The bill would prescribe procedures for a condominium owner to file an action and procedures for the determination of the court. Under the provisions of the bill, the court would be permitted to enter a default judgment and permit a condominium owner to file a motion for a new trial on or before the 30th day after the judgment is signed.The Office of Court Administration reported no significant fiscal impact to the local court is anticipated. Local Government Impact No significant fiscal implication to units of local government is anticipated.
