55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authority of certain general-law municipalities to
88 annex an area without consent.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 43.034, Local Government Code, is
1111 amended to read as follows:
1212 Sec. 43.034. AUTHORITY OF GENERAL-LAW MUNICIPALITY TO ANNEX
1313 AREA; CERTAIN MUNICIPALITIES. A general-law municipality may
1414 annex adjacent territory without the consent of any of the
1515 residents or voters of the area and without the consent of any of
1616 the owners of land in the area if:
1717 (1) the municipality:
1818 (A) has a population of 1,762-1,770, part of
1919 whose boundary is part of the shoreline of a lake whose normal
2020 surface area is 75,000 acres or greater and which is located
2121 completely within the State of Texas; or
2222 (B) has a population of 550-750 and is located in
2323 a county adjacent to a county that:
2424 (i) has a population of more than 1.5
2525 million; and
2626 (ii) contains a municipality in which at
2727 least 75 percent of the county's population resides;
2828 (2) the procedural rules prescribed by this chapter
2929 are met;
3030 (3) the service plan requires that police and fire
3131 protection at a level consistent with protection provided within
3232 the municipality must be provided to the area within 10 days after
3333 the effective date of the annexation; and
3434 (4) the municipality and the affected landowners have
3535 not entered an agreement to not annex the area for a certain period.
3636 SECTION 2. This Act takes effect September 1, 2015.
