66 AN ACT
77 relating to the enforcement of commercial motor vehicle safety
88 standards in certain municipalities and counties.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 644.101(b) and (c), Transportation
1111 Code, are amended to read as follows:
1212 (b) A police officer of any of the following municipalities
1313 is eligible to apply for certification under this section:
1414 (1) a municipality with a population of 50,000 or
1515 more;
1616 (2) a municipality with a population of 25,000 or more
1717 any part of which is located in a county with a population of
1818 500,000 or more;
1919 (3) a municipality with a population of less than
2020 25,000:
2121 (A) any part of which is located in a county with
2222 a population of 3.3 million; and
2323 (B) that contains or is adjacent to an
2424 international port;
2525 (4) a municipality with a population of at least
2626 34,000 that is located in a county that borders two or more states;
2727 (5) a municipality any part of which is located in a
2828 county bordering the United Mexican States;
2929 (6) a municipality with a population of less than
3030 5,000 that is located:
3131 (A) adjacent to a bay connected to the Gulf of
3232 Mexico; and
3333 (B) in a county adjacent to a county with a
3434 population greater than 3.3 million;
3535 (7) a municipality that is located:
3636 (A) within 25 miles of an international port; and
3737 (B) in a county that does not contain a highway
3838 that is part of the national system of interstate and defense
3939 highways and is adjacent to a county with a population greater than
4040 3.3 million; [or]
4141 (8) a municipality with a population of less than
4242 8,500 that:
4343 (A) is the county seat; and
4444 (B) contains a highway that is part of the
4545 national system of interstate and defense highways; or
4646 (9) a municipality located in a county described by
4747 Subsection (c)(3).
4848 (c) A sheriff or a deputy sheriff of any of the following
4949 counties [a county bordering the United Mexican States or of a
5050 county with a population of one million or more] is eligible to
5151 apply for certification under this section:
5252 (1) a county bordering the United Mexican States;
5353 (2) a county with a population of one million or more;
5454 or
5555 (3) a county with a population of less than 100,000
5656 that borders the State of Louisiana and the Gulf Intracoastal
5757 Waterway.
5858 SECTION 2. This Act takes effect September 1, 2015.
