77 AN ACT
88 relating to the transportation and storage of firearms and
99 ammunition in private vehicles on the campuses of institutions of
1010 higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 411.2032, Government Code, is
1313 transferred to Subchapter Z, Chapter 51, Education Code,
1414 redesignated as Section 51.979, Education Code, and amended to read
1515 as follows:
1616 Sec. 51.979 [411.2032]. TRANSPORTATION AND STORAGE OF
1717 FIREARMS AND AMMUNITION [BY LICENSE HOLDERS] IN PRIVATE VEHICLES ON
1818 CERTAIN CAMPUSES. (a) For purposes of this section:
1919 (1) "Campus" means all land and buildings owned or
2020 leased by an institution of higher education or private or
2121 independent institution of higher education.
2222 (2) "Institution of higher education" and "private or
2323 independent institution of higher education" have the meanings
2424 assigned by Section 61.003[, Education Code].
2525 (b) An institution of higher education or private or
2626 independent institution of higher education in this state may not
2727 adopt or enforce any rule, regulation, or other provision or take
2828 any other action, including posting notice under Section 30.06,
2929 Penal Code, prohibiting or placing restrictions on the storage or
3030 transportation of a firearm or ammunition in a locked, privately
3131 owned or leased motor vehicle by a person, including a student
3232 enrolled at that institution, who [holds a license to carry a
3333 concealed handgun under this subchapter and] lawfully possesses the
3434 firearm or ammunition:
3535 (1) on a street or driveway located on the campus of
3636 the institution; or
3737 (2) in a parking lot, parking garage, or other parking
3838 area located on the campus of the institution.
3939 SECTION 2. This Act takes effect September 1, 2015.
