| 7 | 7 | | relating to the legislative appropriations request process for the |

| 8 | 8 | | Texas Department of Transportation. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 322.008, Government Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (b-1) to read as follows: |
|---|
| 12 | 12 | | (b-1) The director shall, as appropriate, organize the |
|---|
| 13 | 13 | | proposed appropriations for the Texas Department of Transportation |
|---|
| 14 | 14 | | in the manner and include the content required under Section |
|---|
| 15 | 15 | | 201.119, Transportation Code. |
|---|
| 16 | 16 | | SECTION 2. Section 201.119, Transportation Code, is amended |
|---|
| 17 | 17 | | by adding Subsections (c), (d), (e), and (f) to read as follows: |
|---|
| 18 | 18 | | (c) Notwithstanding Section 401.042, Government Code, the |
|---|
| 19 | 19 | | department shall develop a zero-based legislative appropriations |
|---|
| 20 | 20 | | request for every third state fiscal biennium that includes: |
|---|
| 21 | 21 | | (1) a citation to: |
|---|
| 22 | 22 | | (A) the department's authority under the Texas |
|---|
| 23 | 23 | | Constitution to operate; and |
|---|
| 24 | 24 | | (B) the law specifying the department's purpose |
|---|
| 25 | 25 | | or mission; and |
|---|
| 26 | 26 | | (2) a list of the department's requests for |
|---|
| 27 | 27 | | legislative appropriations organized by program or activity. |
|---|
| 28 | 28 | | (d) For each specific program or activity described by |
|---|
| 29 | 29 | | Subsection (c)(2), the department must include: |
|---|
| 30 | 30 | | (1) a line item that describes the program or activity |
|---|
| 31 | 31 | | and the purpose of the program or activity and cites the law that |
|---|
| 32 | 32 | | authorizes or requires the program or activity; |
|---|
| 33 | 33 | | (2) a statement of the commission's goals for the |
|---|
| 34 | 34 | | program or activity; |
|---|
| 35 | 35 | | (3) the appropriation made for the program or activity |
|---|
| 36 | 36 | | for the state fiscal biennium preceding the state fiscal biennium |
|---|
| 37 | 37 | | for which the requested appropriation is made; |
|---|
| 38 | 38 | | (4) the amount of the requested appropriation; |
|---|
| 39 | 39 | | (5) a statement that specifies whether the requested |
|---|
| 40 | 40 | | appropriation for the program or activity is from nondedicated |
|---|
| 41 | 41 | | money in the general revenue fund, dedicated money in the general |
|---|
| 42 | 42 | | revenue fund, the state highway fund, federal money, or another |
|---|
| 43 | 43 | | source; |
|---|
| 44 | 44 | | (6) the number of full-time equivalent employees |
|---|
| 45 | 45 | | authorized for the program or activity for the state fiscal |
|---|
| 46 | 46 | | biennium preceding the state fiscal biennium for which the |
|---|
| 47 | 47 | | requested appropriation is made and the number of full-time |
|---|
| 48 | 48 | | equivalent employees for the biennium that would be authorized |
|---|
| 49 | 49 | | under the requested appropriation; |
|---|
| 50 | 50 | | (7) an itemized account of expenditures required to |
|---|
| 51 | 51 | | maintain the minimum level of service required by law to be provided |
|---|
| 52 | 52 | | through the program or activity and a succinct statement of the |
|---|
| 53 | 53 | | quantity and quality of services provided at that minimum level; |
|---|
| 54 | 54 | | and |
|---|
| 55 | 55 | | (8) an itemized account of expenditures required to |
|---|
| 56 | 56 | | maintain the current level of service provided through the program |
|---|
| 57 | 57 | | or activity and a succinct statement of the quantity and quality of |
|---|
| 58 | 58 | | services provided at the current level. |
|---|
| 59 | 59 | | (e) Line items described by Subsection (d)(1) must be |
|---|
| 60 | 60 | | grouped together according to the level in the department's |
|---|
| 61 | 61 | | organizational structure at which budgetary authority for the |
|---|
| 62 | 62 | | program or activity represented by a line item is exercised by a |
|---|
| 63 | 63 | | manager who has authority over the department's finances. |
|---|
| 64 | 64 | | (f) For each legislative appropriations request made in the |
|---|
| 65 | 65 | | manner required by Subsection (c), the commission shall develop and |
|---|
| 66 | 66 | | submit to the Legislative Budget Board a ranking of the programs and |
|---|
| 67 | 67 | | activities represented by the line items according to the relative |
|---|
| 68 | 68 | | importance of each program and activity to the overall goals and |
|---|
| 69 | 69 | | purposes of the department and the commission. |
|---|
| 70 | 70 | | SECTION 3. (a) Section 322.008, Government Code, as |
|---|
| 71 | 71 | | amended by this Act, applies beginning with the general |
|---|
| 72 | 72 | | appropriations bill prepared for the 2018-2019 state fiscal |
|---|
| 73 | 73 | | biennium. |
|---|
| 74 | 74 | | (b) The Texas Department of Transportation shall develop |
|---|
| 75 | 75 | | and submit a zero-based legislative appropriations request as |
|---|
| 76 | 76 | | required by Section 201.119, Transportation Code, as amended by |
|---|
| 77 | 77 | | this Act, beginning with the department's legislative |
|---|
| 78 | 78 | | appropriations request for the 2018-2019 state fiscal biennium. |
|---|
| 79 | 79 | | SECTION 4. This Act takes effect September 1, 2015. |
