55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the legislative appropriations request process for the
88 Texas Department of Transportation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 322.008, Government Code, is amended by
1111 adding Subsection (b-1) to read as follows:
1212 (b-1) The director shall, as appropriate, organize the
1313 proposed appropriations for the Texas Department of Transportation
1414 in the manner and include the content required under Section
1515 201.119, Transportation Code.
1616 SECTION 2. Section 201.119, Transportation Code, is amended
1717 by adding Subsections (c), (d), (e), and (f) to read as follows:
1818 (c) Notwithstanding Section 401.042, Government Code, the
1919 department shall develop a zero-based legislative appropriations
2020 request for every third state fiscal biennium that includes:
2121 (1) a citation to:
2222 (A) the department's authority under the Texas
2323 Constitution to operate; and
2424 (B) the law specifying the department's purpose
2525 or mission; and
2626 (2) a list of the department's requests for
2727 legislative appropriations organized by program or activity.
2828 (d) For each specific program or activity described by
2929 Subsection (c)(2), the department must include:
3030 (1) a line item that describes the program or activity
3131 and the purpose of the program or activity and cites the law that
3232 authorizes or requires the program or activity;
3333 (2) a statement of the commission's goals for the
3434 program or activity;
3535 (3) the appropriation made for the program or activity
3636 for the state fiscal biennium preceding the state fiscal biennium
3737 for which the requested appropriation is made;
3838 (4) the amount of the requested appropriation;
3939 (5) a statement that specifies whether the requested
4040 appropriation for the program or activity is from nondedicated
4141 money in the general revenue fund, dedicated money in the general
4242 revenue fund, the state highway fund, federal money, or another
4343 source;
4444 (6) the number of full-time equivalent employees
4545 authorized for the program or activity for the state fiscal
4646 biennium preceding the state fiscal biennium for which the
4747 requested appropriation is made and the number of full-time
4848 equivalent employees for the biennium that would be authorized
4949 under the requested appropriation;
5050 (7) an itemized account of expenditures required to
5151 maintain the minimum level of service required by law to be provided
5252 through the program or activity and a succinct statement of the
5353 quantity and quality of services provided at that minimum level;
5454 and
5555 (8) an itemized account of expenditures required to
5656 maintain the current level of service provided through the program
5757 or activity and a succinct statement of the quantity and quality of
5858 services provided at the current level.
5959 (e) Line items described by Subsection (d)(1) must be
6060 grouped together according to the level in the department's
6161 organizational structure at which budgetary authority for the
6262 program or activity represented by a line item is exercised by a
6363 manager who has authority over the department's finances.
6464 (f) For each legislative appropriations request made in the
6565 manner required by Subsection (c), the commission shall develop and
6666 submit to the Legislative Budget Board a ranking of the programs and
6767 activities represented by the line items according to the relative
6868 importance of each program and activity to the overall goals and
6969 purposes of the department and the commission.
7070 SECTION 3. (a) Section 322.008, Government Code, as
7171 amended by this Act, applies beginning with the general
7272 appropriations bill prepared for the 2018-2019 state fiscal
7373 biennium.
7474 (b) The Texas Department of Transportation shall develop
7575 and submit a zero-based legislative appropriations request as
7676 required by Section 201.119, Transportation Code, as amended by
7777 this Act, beginning with the department's legislative
7878 appropriations request for the 2018-2019 state fiscal biennium.
7979 SECTION 4. This Act takes effect September 1, 2015.
