55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the punishment for subsequent convictions
88 for indecent exposure.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 21.08, Penal Code, is amended by
1111 amending Subsection (b) and adding Subsection (c) to read as
1212 follows:
1313 (b) An offense under this section is a Class B misdemeanor,
1414 except that the offense is a state jail felony if it is shown on the
1515 trial of the offense that the defendant has been previously
1616 convicted two or more times of an offense under this section.
1717 (c) For purposes of Subsection (b), a defendant has been
1818 previously convicted under this section if the defendant was
1919 adjudged guilty of the offense or entered a plea of guilty or nolo
2020 contendere in return for a grant of deferred adjudication,
2121 regardless of whether the sentence for the offense was ever imposed
2222 or whether the sentence was probated and the defendant was
2323 subsequently discharged from community supervision.
2424 SECTION 2. The change in law made by this Act applies only
2525 to an offense committed on or after the effective date of this Act.
2626 An offense committed before the effective date of this Act is
2727 governed by the law in effect on the date the offense was committed,
2828 and the former law is continued in effect for that purpose. For
2929 purposes of this section, an offense was committed before the
3030 effective date of this Act if any element of the offense occurred
3131 before that date.
3232 SECTION 3. This Act takes effect September 1, 2015.
