| 7 | 7 | | relating to the procedure for adoption by a state agency of rules |

| 8 | 8 | | that may have an adverse economic effect on small businesses and |

| 9 | 9 | | micro-businesses. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2006.002, Government Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (h) to read as follows: |
|---|
| 13 | 13 | | (h) If a state agency is made aware that a proposed rule may |
|---|
| 14 | 14 | | have an adverse economic effect on small businesses or |
|---|
| 15 | 15 | | micro-businesses after notice of the proposed rule has been |
|---|
| 16 | 16 | | published, the agency shall: |
|---|
| 17 | 17 | | (1) prepare an economic impact statement and a |
|---|
| 18 | 18 | | regulatory flexibility analysis as required under Subsections (c) |
|---|
| 19 | 19 | | and (c-1); |
|---|
| 20 | 20 | | (2) publish the statement and the analysis in the |
|---|
| 21 | 21 | | Texas Register as an amendment to the proposed rule; and |
|---|
| 22 | 22 | | (3) provide a copy of the statement and the analysis to |
|---|
| 23 | 23 | | the standing committee of each house of the legislature charged |
|---|
| 24 | 24 | | with reviewing the proposed rule. |

| 25 | 25 | | SECTION 2. The changes in law made by this Act to Section |
|---|
| 26 | 26 | | 2006.002, Government Code, apply only to a rule proposed by a state |
|---|
| 27 | 27 | | agency on or after the effective date of this Act. A rule proposed |
|---|
| 28 | 28 | | by a state agency before the effective date of this Act is governed |
|---|
| 29 | 29 | | by the law in effect on the date the rule was proposed, and the |
|---|
| 30 | 30 | | former law is continued in effect for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2015. |
