66 AN ACT
77 relating to prompt payment of certain physicians and health care
88 providers by a preferred provider benefit plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1301.069, Insurance Code, is amended to
1111 read as follows:
1212 Sec. 1301.069. SERVICES PROVIDED BY CERTAIN PHYSICIANS AND
1313 HEALTH CARE PROVIDERS. The provisions of this chapter relating to
1414 prompt payment by an insurer of a physician or health care provider
1515 and to verification of medical care or health care services apply to
1616 a physician or provider who:
1717 (1) is not a preferred provider included in the
1818 preferred provider network; and
1919 (2) provides to an insured:
2020 (A) care related to an emergency or its attendant
2121 episode of care as required by state or federal law; or
2222 (B) specialty or other medical care or health
2323 care services at the request of the insurer, [or] a preferred
2424 provider, or an insured with out-of-network coverage [because the
2525 services are not reasonably available from a preferred provider who
2626 is included in the preferred delivery network].
2727 SECTION 2. The change in law made by this Act applies only
2828 to payment of a claim submitted to an insurer for payment on or
2929 after January 1, 2016. A claim submitted before January 1, 2016, is
3030 governed by the law as it existed immediately before the effective
3131 date of this Act, and that law is continued in effect for that
3232 purpose.
3333 SECTION 3. This Act takes effect September 1, 2015.
