5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to prompt payment of certain physicians and health care
8	8	providers by a preferred provider benefit plan.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1301.069, Insurance Code, is amended to
11	11	read as follows:
12	12	Sec. 1301.069. SERVICES PROVIDED BY CERTAIN PHYSICIANS AND
13	13	HEALTH CARE PROVIDERS. The provisions of this chapter relating to
14	14	prompt payment by an insurer of a physician or health care provider
15	15	and to verification of medical care or health care services apply to
16	16	a physician or provider who:
17	17	(1) is not a preferred provider included in the
18	18	preferred provider network; and
19	19	(2) provides to an insured:
20	20	(A) care related to an emergency or its attendant
21	21	episode of care as required by state or federal law; or
22	22	(B) specialty or other medical care or health
23	23	care services at the request of the insurer, [or] a preferred
24	24	provider, or an insured with out-of-network coverage [because the
25	25	services are not reasonably available from a preferred provider who
26	26	is included in the preferred delivery network].
27	27	SECTION 2. The change in law made by this Act applies only
28	28	to payment of a claim submitted to an insurer for payment on or
29	29	after January 1, 2016. A claim submitted before January 1, 2016, is
30	30	governed by the law as it existed immediately before the effective
31	31	date of this Act, and that law is continued in effect for that
32	32	purpose.
33	33	SECTION 3. This Act takes effect September 1, 2015.
