| 7 | 7 | | relating to a report by the comptroller on wage theft. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. REPORT ON WAGE THEFT. (a) The comptroller of |
|---|
| 10 | 10 | | public accounts, in cooperation with the Texas Workforce |
|---|
| 11 | 11 | | Commission, shall prepare a report on wage theft by employers in |
|---|
| 12 | 12 | | this state. |
|---|
| 13 | 13 | | (b) The report must include: |
|---|
| 14 | 14 | | (1) information regarding the demographic groups and |
|---|
| 15 | 15 | | industries most affected by wage theft; |
|---|
| 16 | 16 | | (2) an analysis of the economic impact of wage theft on |
|---|
| 17 | 17 | | employees and its effect on competition within an industry; and |
|---|
| 18 | 18 | | (3) an analysis, prepared by the Texas Workforce |
|---|
| 19 | 19 | | Commission, of: |
|---|
| 20 | 20 | | (A) remedies available to victims of wage theft |
|---|
| 21 | 21 | | under state and federal law; |
|---|
| 22 | 22 | | (B) procedural difficulties in pursuing a remedy |
|---|
| 23 | 23 | | under state or federal law; and |
|---|
| 24 | 24 | | (C) recommendations for legislation to address |
|---|
| 25 | 25 | | the difficulties described by Paragraph (B). |
|---|
| 26 | 26 | | (c) Not later than December 1, 2016, the comptroller shall |
|---|
| 27 | 27 | | provide a copy of the report to: |
|---|
| 28 | 28 | | (1) the governor; |
|---|
| 29 | 29 | | (2) the lieutenant governor; |
|---|
| 30 | 30 | | (3) the speaker of the house of representatives; and |
|---|
| 31 | 31 | | (4) each standing committee of the senate and house of |
|---|
| 32 | 32 | | representatives having primary jurisdiction over matters relating |
|---|
| 33 | 33 | | to labor and employment. |
|---|
| 34 | 34 | | SECTION 2. EXPIRATION. This Act expires June 1, 2017. |
|---|
| 35 | 35 | | SECTION 3. EFFECTIVE DATE. This Act takes effect September |
|---|
| 36 | 36 | | 1, 2015. |
