| 7 | 7 | | relating to the criminal and civil prosecution of certain offenses |

| 8 | 8 | | involving parking in a space designated for persons with |
|---|
| 9 | 9 | | disabilities. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Article 14.06(d), Code of Criminal Procedure, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (d) Subsection (c) applies only to a person charged with |
|---|
| 14 | 14 | | committing an offense under: |
|---|
| 15 | 15 | | (1) Section 481.121, Health and Safety Code, if the |
|---|
| 16 | 16 | | offense is punishable under Subsection (b)(1) or (2) of that |
|---|
| 17 | 17 | | section; |
|---|
| 18 | 18 | | (1-a) Section 481.1161, Health and Safety Code, if the |
|---|
| 19 | 19 | | offense is punishable under Subsection (b)(1) or (2) of that |
|---|
| 20 | 20 | | section; |
|---|
| 21 | 21 | | (2) Section 28.03, Penal Code, if the offense is |
|---|
| 22 | 22 | | punishable under Subsection (b)(2) of that section; |
|---|
| 23 | 23 | | (3) Section 28.08, Penal Code, if the offense is |
|---|
| 24 | 24 | | punishable under Subsection (b)(1) of that section; |
|---|
| 25 | 25 | | (4) Section 31.03, Penal Code, if the offense is |
|---|
| 26 | 26 | | punishable under Subsection (e)(2)(A) of that section; |
|---|
| 27 | 27 | | (5) Section 31.04, Penal Code, if the offense is |
|---|
| 28 | 28 | | punishable under Subsection (e)(2) of that section; |
|---|
| 29 | 29 | | (6) Section 38.114, Penal Code, if the offense is |
|---|
| 30 | 30 | | punishable as a Class B misdemeanor; [or] |
|---|
| 31 | 31 | | (7) Section 521.457, Transportation Code; or |
|---|
| 32 | 32 | | (8) Section 681.011, Transportation Code. |
|---|
| 33 | 33 | | SECTION 2. Section 682.002, Transportation Code, is amended |
|---|
| 34 | 34 | | to read as follows: |
|---|
| 35 | 35 | | Sec. 682.002. CIVIL OFFENSE. (a) A municipality may |
|---|
| 36 | 36 | | declare the violation of a municipal ordinance relating to parking |
|---|
| 37 | 37 | | or stopping a vehicle, including parking or stopping a vehicle in a |
|---|
| 38 | 38 | | manner that would constitute an offense under Section 681.011, to |
|---|
| 39 | 39 | | be a civil offense. |
|---|
| 40 | 40 | | (b) A joint board to which Section 22.074(d) applies may |
|---|
| 41 | 41 | | declare the violation of a resolution, rule, or order of the joint |
|---|
| 42 | 42 | | board relating to parking or stopping a vehicle, including parking |
|---|
| 43 | 43 | | or stopping a vehicle in a manner that would constitute an offense |
|---|
| 44 | 44 | | under Section 681.011, to be a civil offense. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2015. |
