55 AN ACT
66 relating to the regulation of automotive wrecking and salvage yards
77 in certain counties; increasing the civil penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 397.0125(a), Transportation Code, is
1010 amended to read as follows:
1111 (a) In addition to the penalty provided by Section 397.012,
1212 a person who operates an automotive wrecking and salvage yard in
1313 violation of this chapter is liable for a civil penalty of not less
1414 than $500 or more than $5,000 [$1,000] for each violation. A
1515 separate penalty may be imposed for each day a continuing violation
1616 occurs.
1717 SECTION 2. The change in law made by this Act applies only
1818 to a violation of Chapter 397, Transportation Code, that occurs on
1919 or after the effective date of this Act. A violation of that
2020 chapter that occurred before the effective date of this Act is
2121 governed by the law in effect when the violation occurred, and the
2222 former law is continued in effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2015.
