108 relating to the establishment of a state plan for Streptococcus
119 pneumoniae education and prevention.
1210 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1311 SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
1412 amended by adding Chapter 94A to read as follows:
1513 CHAPTER 94A. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE; EDUCATION
1614 AND PREVENTION PROGRAM
1715 Sec. 94A.001. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE. (a)
1816 The department, using existing resources and programs to the extent
1917 possible, shall develop a state plan for prevention and treatment
2018 of diseases caused by Streptococcus pneumoniae. The plan must
2119 include strategies for prevention and treatment of diseases caused
2220 by Streptococcus pneumoniae in specific demographic groups that are
2321 disproportionately affected by the diseases, including persons who
2422 are elderly, children under two years of age, persons living in
2523 long-term care facilities, persons with a chronic heart or lung
2624 disease, smokers, and persons with asplenia.
2725 (b) In developing the plan, the department with the
2826 assistance of the executive commissioner shall seek the input of:
2927 (1) the public, including members of the public who
3028 have had diseases caused by Streptococcus pneumoniae;
3129 (2) each state agency that provides services to
3230 persons infected with Streptococcus pneumoniae or the functions of
3331 which otherwise involve diseases caused by Streptococcus
3432 pneumoniae, including any appropriate health and human services
3533 agency described by Section 531.001, Government Code, the Employees
3634 Retirement System of Texas, and the Teacher Retirement System of
3735 Texas;
3836 (3) any advisory body that addresses issues related to
3937 diseases caused by Streptococcus pneumoniae;
4038 (4) public advocates concerned with issues related to
4139 vaccine-preventable diseases;
4240 (5) providers of services to persons with diseases
4341 caused by Streptococcus pneumoniae; and
4442 (6) a statewide professional association of
4543 physicians.
4644 (c) The department shall update the state plan developed
4745 under this section at least once every five years and may update the
4846 state plan biennially.
4947 Sec. 94A.002. STREPTOCOCCUS PNEUMONIAE EDUCATION AND
5048 PREVENTION PROGRAM. (a) The department shall develop a program to
5149 heighten awareness and enhance knowledge and understanding of
5250 Streptococcus pneumoniae.
5351 (b) The program developed under Subsection (a) must require
5452 the department to:
5553 (1) conduct health education, public awareness, and
5654 community outreach activities to promote public awareness and
5755 knowledge about the risk factors for, the value of early detection
5856 of, available screening services for, and the options available for
5957 the treatment of diseases caused by Streptococcus pneumoniae; and
6058 (2) post on the department's Internet website the
6159 options available for the prevention, treatment, and detection of
6260 diseases caused by Streptococcus pneumoniae and information on the
6361 risk factors for, method of transmission of, and value of early
6462 detection of the diseases.
6563 (c) The department, using existing resources, may include
6664 in the program developed under Subsection (a) a study to estimate
6765 the current and future impact of diseases caused by Streptococcus
6866 pneumoniae on this state.
6967 SECTION 2. This Act takes effect September 1, 2015.
