9	7		AN ACT
10	8		relating to the establishment of a state plan for Streptococcus
11	9		pneumoniae education and prevention.
12	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	11		SECTION 1. Subtitle D, Title 2, Health and Safety Code, is
14	12		amended by adding Chapter 94A to read as follows:
15	13		CHAPTER 94A. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE; EDUCATION
16	14		AND PREVENTION PROGRAM
17	15		Sec. 94A.001. STATE PLAN FOR STREPTOCOCCUS PNEUMONIAE. (a)
18	16		The department, using existing resources and programs to the extent
19	17		possible, shall develop a state plan for prevention and treatment
20	18		of diseases caused by Streptococcus pneumoniae. The plan must
21	19		include strategies for prevention and treatment of diseases caused
22	20		by Streptococcus pneumoniae in specific demographic groups that are
23	21		disproportionately affected by the diseases, including persons who
24	22		are elderly, children under two years of age, persons living in
25	23		long-term care facilities, persons with a chronic heart or lung
26	24		disease, smokers, and persons with asplenia.
27	25		(b) In developing the plan, the department with the
28	26		assistance of the executive commissioner shall seek the input of:
29	27		(1) the public, including members of the public who
30	28		have had diseases caused by Streptococcus pneumoniae;
31	29		(2) each state agency that provides services to
32	30		persons infected with Streptococcus pneumoniae or the functions of
33	31		which otherwise involve diseases caused by Streptococcus
34	32		pneumoniae, including any appropriate health and human services
35	33		agency described by Section 531.001, Government Code, the Employees
36	34		Retirement System of Texas, and the Teacher Retirement System of
37	35		Texas;
38	36		(3) any advisory body that addresses issues related to
39	37		diseases caused by Streptococcus pneumoniae;
40	38		(4) public advocates concerned with issues related to
41	39		vaccine-preventable diseases;
42	40		(5) providers of services to persons with diseases
43	41		caused by Streptococcus pneumoniae; and
44	42		(6) a statewide professional association of
45	43		physicians.
46	44		(c) The department shall update the state plan developed
47	45		under this section at least once every five years and may update the
48	46		state plan biennially.
49	47		Sec. 94A.002. STREPTOCOCCUS PNEUMONIAE EDUCATION AND
50	48		PREVENTION PROGRAM. (a) The department shall develop a program to
51	49		heighten awareness and enhance knowledge and understanding of
52	50		Streptococcus pneumoniae.
53	51		(b) The program developed under Subsection (a) must require
54	52		the department to:
55	53		(1) conduct health education, public awareness, and
56	54		community outreach activities to promote public awareness and
57	55		knowledge about the risk factors for, the value of early detection
58	56		of, available screening services for, and the options available for
59	57		the treatment of diseases caused by Streptococcus pneumoniae; and
60	58		(2) post on the department's Internet website the
61	59		options available for the prevention, treatment, and detection of
62	60		diseases caused by Streptococcus pneumoniae and information on the
63	61		risk factors for, method of transmission of, and value of early
64	62		detection of the diseases.
65	63		(c) The department, using existing resources, may include
66	64		in the program developed under Subsection (a) a study to estimate
67	65		the current and future impact of diseases caused by Streptococcus
68	66		pneumoniae on this state.
69	67		SECTION 2. This Act takes effect September 1, 2015.
