55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the use of the universal service fund to provide
88 Internet service to certain persons with an impairment of hearing.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 56.021, Utilities Code, is amended to
1111 read as follows:
1212 Sec. 56.021. UNIVERSAL SERVICE FUND ESTABLISHED. The
1313 commission shall adopt and enforce rules requiring local exchange
1414 companies to establish a universal service fund to:
1515 (1) assist telecommunications providers in providing
1616 basic local telecommunications service at reasonable rates in high
1717 cost rural areas under two plans:
1818 (A) the Texas High Cost Universal Service Plan
1919 (16 T.A.C. Section 26.403); and
2020 (B) the Small and Rural Incumbent Local Exchange
2121 Company Universal Service Plan (16 T.A.C. Section 26.404);
2222 (2) reimburse the telecommunications carrier that
2323 provides the statewide telecommunications relay access service
2424 under Subchapter D;
2525 (3) finance the specialized telecommunications
2626 assistance program established under Subchapter E;
2727 (4) reimburse the department and the commission for
2828 costs incurred in implementing this chapter and Chapter 57;
2929 (5) reimburse a telecommunications carrier providing
3030 lifeline service as provided by 47 C.F.R. Part 54, Subpart E, as
3131 amended;
3232 (6) finance the implementation and administration of
3333 an integrated eligibility process created under Section 17.007 for
3434 customer service discounts relating to telecommunications
3535 services, including outreach expenses the commission determines
3636 are reasonable and necessary;
3737 (7) reimburse a designated provider under Subchapter
3838 F;
3939 (8) reimburse a successor utility under Subchapter G;
4040 [and]
4141 (9) finance the program established under Subchapter
4242 H; and
4343 (10) reimburse a telecommunications carrier that
4444 provides Internet service under Subchapter I.
4545 SECTION 2. Chapter 56, Utilities Code, is amended by adding
4646 Subchapter I to read as follows:
4747 SUBCHAPTER I. INTERNET SERVICE PROGRAM FOR PERSONS WITH IMPAIRMENT
4848 OF HEARING
4949 Sec. 56.351. INTERNET SERVICE PROGRAM. The commission by
5050 rule shall establish and implement a program to provide from the
5151 universal service fund reimbursement for free or discounted
5252 Internet service provided by a telecommunications carrier to a
5353 person with an impairment of hearing who is eligible for lifeline
5454 service as provided by 47 C.F.R. Part 54, Subpart E, as amended.
5555 SECTION 3. This Act takes effect September 1, 2015.
