108 Act.
119 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1210 SECTION 1. Chapter 2051, Government Code, is amended by
1311 adding Subchapter E to read as follows:
1412 SUBCHAPTER E. UNIFORM ELECTRONIC LEGAL MATERIAL ACT
1513 Sec. 2051.151. SHORT TITLE. This subchapter may be cited as
1614 the Uniform Electronic Legal Material Act.
1715 Sec. 2051.152. DEFINITIONS. In this subchapter:
1816 (1) "Electronic" means relating to technology having
1917 electrical, digital, magnetic, wireless, optical, electromagnetic,
2018 or similar capabilities.
2119 (2) "Legal material" means, whether or not in effect:
2220 (A) the constitution and statutes of this state;
2321 (B) the general or special laws passed in a
2422 regular or special session of the Texas Legislature; and
2523 (C) a state agency rule adopted in accordance
2624 with Chapter 2001.
2725 (3) "Official publisher" means:
2826 (A) for legal material described by Subdivision
2927 (2)(A), the Texas Legislative Council; and
3028 (B) for legal material described by Subdivision
3129 (2)(B) or (C), the secretary of state.
3230 (4) "Publish" means displaying, presenting, or
3331 releasing to the public, or causing to be displayed, presented, or
3432 released to the public, legal material by the official publisher.
3533 (5) "Record" means information that is inscribed on a
3634 tangible medium or that is stored in an electronic or other medium
3735 and is retrievable in perceivable form.
3836 (6) "State" means a state of the United States, the
3937 District of Columbia, Puerto Rico, the United States Virgin
4038 Islands, or any territory or insular possession subject to the
4139 jurisdiction of the United States.
4240 Sec. 2051.153. APPLICABILITY. This subchapter applies to
4341 all legal material in an electronic record that is:
4442 (1) designated as official by the official publisher
4543 under Section 2051.154; and
4644 (2) first published electronically by the official
4745 publisher on or after January 1, 2017.
4846 Sec. 2051.154. LEGAL MATERIAL IN OFFICIAL ELECTRONIC
4947 RECORD. (a) If the official publisher publishes legal material
5048 only in an electronic record, the official publisher shall:
5149 (1) designate the electronic record as official; and
5250 (2) comply with Sections 2051.155, 2051.157, and
5351 2051.158.
5452 (b) If the official publisher publishes legal material in an
5553 electronic record and also publishes the material in a record other
5654 than an electronic record, the official publisher may designate the
5755 electronic record as official if the official publisher complies
5856 with Sections 2051.155, 2051.157, and 2051.158.
5957 Sec. 2051.155. AUTHENTICATION OF OFFICIAL ELECTRONIC
6058 RECORD. (a) If the official publisher designates an electronic
6159 record as official in accordance with Section 2051.154, the
6260 official publisher shall authenticate the record.
6361 (b) The official publisher authenticates an electronic
6462 record by providing a method with which a person viewing the
6563 electronic record is able to determine that the electronic record
6664 is unaltered from the official record published by the official
6765 publisher.
6866 Sec. 2051.156. EFFECT OF AUTHENTICATION. (a) Legal
6967 material in an electronic record that is authenticated as provided
7068 by Section 2051.155 is presumed to be an accurate copy of the legal
7169 material.
7270 (b) If another state has adopted a law that is substantially
7371 similar to this subchapter, legal material in an electronic record
7472 that is authenticated in that state is presumed to be an accurate
7573 copy of the legal material.
7674 (c) A party contesting the authenticity of legal material in
7775 an electronic record authenticated as provided by Section 2051.155
7876 has the burden of proving by a preponderance of the evidence that
7977 the record is not authentic.
8078 Sec. 2051.157. PRESERVATION AND SECURITY OF LEGAL MATERIAL
8179 IN OFFICIAL ELECTRONIC RECORD. (a) The official publisher of legal
8280 material in an electronic record designated as official in
8381 accordance with Section 2051.154 shall provide for the preservation
8482 and security of the record in an electronic form or in a form that is
8583 not electronic.
8684 (b) If legal material is preserved under Subsection (a) in
8785 an electronic record, the official publisher shall:
8886 (1) ensure the integrity of the record;
8987 (2) provide for backup and disaster recovery of the
9088 record; and
9189 (3) ensure the continuing usability of the legal
9290 material in the record.
9391 Sec. 2051.158. PUBLIC ACCESS. The official publisher of
9492 legal material in an electronic record that is required to be
9593 preserved under Section 2051.157 shall ensure that the material is
9694 reasonably available for use by the public on a permanent basis.
9795 Sec. 2051.159. STANDARDS. In implementing this subchapter,
9896 the official publisher of legal material in an electronic record
9997 shall consider:
10098 (1) the standards and practices of other
10199 jurisdictions;
102100 (2) the most recent standards regarding
103101 authentication, preservation, and security of and public access to
104102 legal material in an electronic record and other electronic
105103 records, as adopted by national standard-setting bodies;
106104 (3) the needs of users of legal material in electronic
107105 records;
108106 (4) the views of governmental officials and entities
109107 and other interested persons; and
110108 (5) to the extent practicable, the methods and
111109 technologies for the authentication, preservation, and security of
112110 and public access to legal material that are compatible with the
113111 methods and technologies used by official publishers in other
114112 states that have adopted a law that is substantially similar to this
115113 subchapter.
116114 Sec. 2051.160. UNIFORMITY OF APPLICATION AND CONSTRUCTION.
117115 In applying and construing this subchapter, consideration must be
118116 given to the need to promote uniformity of the law with respect to
119117 the subject matter of this subchapter among the states that enact a
120118 law similar to this subchapter.
121119 Sec. 2051.161. RELATION TO ELECTRONIC SIGNATURES IN GLOBAL
122120 AND NATIONAL COMMERCE ACT. This subchapter modifies, limits, and
123121 supersedes the federal Electronic Signatures in Global and National
124122 Commerce Act (15 U.S.C. Section 7001 et seq.) but does not modify,
125123 limit, or supersede Section 101(c) of that Act (15 U.S.C. Section
126124 7001(c)) or authorize electronic delivery of any of the notices
127125 described in Section 103(b) of that Act (15 U.S.C. Section
128126 7003(b)).
129127 SECTION 2. This Act takes effect September 1, 2015.
