66 AN ACT
77 relating to the use of and training for incident-based reporting of
88 information and statistics concerning criminal offenses committed
99 in this state.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 411.042, Government Code, is amended by
1212 adding Subsection (k) to read as follows:
1313 (k) The department shall publish and periodically update on
1414 the department's Internet website incident-based information and
1515 statistics concerning criminal offenses committed in this state.
1616 SECTION 2. Subchapter D, Chapter 411, Government Code, is
1717 amended by adding Section 411.054 to read as follows:
1818 Sec. 411.054. INCIDENT-BASED CRIME STATISTICS REPORTING
1919 PLAN. (a) The department shall develop a plan for implementing and
2020 expanding the use of an incident-based reporting system by state
2121 and local law enforcement agencies to report information and
2222 statistics concerning criminal offenses committed in this state.
2323 (b) The plan described by Subsection (a) must:
2424 (1) build on available experience and infrastructure
2525 for reporting information and statistics concerning criminal
2626 offenses;
2727 (2) identify additional resource needs for
2828 implementing and expanding the use of an incident-based reporting
2929 system;
3030 (3) contain input from stakeholders, including other
3131 law enforcement agencies and law enforcement associations,
3232 advocacy groups, and academic institutions;
3333 (4) contain outreach strategies to educate the public
3434 on the differences between a summary reporting system and an
3535 incident-based reporting system;
3636 (5) contain measures to track the progress and success
3737 in this state of any incident-based reporting by state and local law
3838 enforcement agencies to the National Incident-Based Reporting
3939 System of the Uniform Crime Reporting Program of the Federal Bureau
4040 of Investigation, the Texas Incident-Based Reporting System of the
4141 department, or a successor program; and
4242 (6) examine the feasibility and desirability of
4343 purchasing or developing for state and local law enforcement
4444 agencies a records management system that meets the reporting
4545 requirements of the National Incident-Based Reporting System of the
4646 Uniform Crime Reporting Program of the Federal Bureau of
4747 Investigation, the Texas Incident-Based Reporting System of the
4848 department, or a successor program.
4949 (c) Not later than September 1 of each even-numbered year,
5050 the department shall submit the plan to the governor, lieutenant
5151 governor, speaker of the house of representatives, appropriate
5252 standing committees of the legislature, and Legislative Budget
5353 Board.
5454 SECTION 3. Section 1701.156, Occupations Code, is amended
5555 by adding Subsection (c) to read as follows:
5656 (c) The Department of Public Safety may use money
5757 appropriated to the department from the account to award grants to
5858 local law enforcement agencies for training on incident-based
5959 reporting systems to be used for reporting information and
6060 statistics concerning criminal offenses committed in this state.
6161 The department shall adopt rules governing the award of grants by
6262 the department under this subsection.
6363 SECTION 4. Section 1701.157, Occupations Code, is amended
6464 by adding Subsection (a-1) to read as follows:
6565 (a-1) Subsection (a) does not apply to money appropriated to
6666 the Department of Public Safety from the account for the purpose of
6767 awarding grants to local law enforcement agencies for training on
6868 incident-based reporting systems under Section 1701.156(c).
6969 SECTION 5. Not later than January 1, 2016, the Department of
7070 Public Safety shall adopt rules as required by Section 1701.156(c),
7171 Occupations Code, as added by this Act.
7272 SECTION 6. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2015.
