66 AN ACT
77 relating to a prescription drug misuse awareness component of the
88 health curriculum used in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002, Education Code, is amended by
1111 adding Subsection (w) to read as follows:
1212 (w) In adopting the essential knowledge and skills for the
1313 health curriculum under Subsection (a)(2)(B), the State Board of
1414 Education shall adopt essential knowledge and skills that address
1515 the dangers, causes, consequences, signs, symptoms, and treatment
1616 of nonmedical use of prescription drugs. The agency shall compile a
1717 list of evidence-based prescription drug misuse awareness programs
1818 from which a school district shall choose a program to use in the
1919 district's middle school, junior high school, and high school
2020 health curriculums. In this subsection, an "evidence-based
2121 prescription drug misuse awareness program" means a program,
2222 practice, or strategy that has been proven to effectively prevent
2323 nonmedical use of prescription drugs among students, as determined
2424 by evaluations that use valid and reliable measures and that are
2525 published in peer-reviewed journals.
2626 SECTION 2. This Act applies beginning with the 2015-2016
2727 school year.
2828 SECTION 3. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2015.
