77 relating to the name and governance of the Railroad Commission of
88 Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 81, Natural Resources
1111 Code, is amended to read as follows:
1212 CHAPTER 81. TEXAS ENERGY RESOURCES [RAILROAD] COMMISSION [OF TEXAS]
1313 SECTION 2. Section 81.001, Natural Resources Code, is
1414 amended to read as follows:
1515 Sec. 81.001. DEFINITIONS. In this chapter:
1616 (1) "Commission" means the Texas Energy Resources
1717 [Railroad] Commission [of Texas].
1818 (2) "Commissioner" means any member of the Texas
1919 Energy Resources [Railroad] Commission [of Texas].
2020 SECTION 3. Subchapter A, Chapter 81, Natural Resources
2121 Code, is amended by adding Section 81.003 to read as follows:
2222 Sec. 81.003. TEXAS ENERGY RESOURCES COMMISSION. (a) The
2323 Railroad Commission of Texas is renamed the Texas Energy Resources
2424 Commission.
2525 (b) A reference in law to:
2626 (1) the Railroad Commission of Texas means the Texas
2727 Energy Resources Commission; and
2828 (2) a railroad commissioner or a member of the
2929 Railroad Commission of Texas means a member of the Texas Energy
3030 Resources Commission.
3131 SECTION 4. Section 81.01001, Natural Resources Code, is
3232 amended to read as follows:
3333 Sec. 81.01001. SUNSET PROVISION. (a) The Texas Energy
3434 Resources [Railroad] Commission [of Texas] is subject to Chapter
3535 325, Government Code (Texas Sunset Act). Unless continued in
3636 existence as provided by that chapter, the commission is abolished
3737 September 1, 2017.
3838 (a-1) The review of the Texas Energy Resources [Railroad]
3939 Commission [of Texas] by the Sunset Advisory Commission in
4040 preparation for the work of the 85th Legislature in Regular Session
4141 is not limited to the appropriateness of recommendations made by
4242 the Sunset Advisory Commission to the 83rd Legislature. In the
4343 Sunset Advisory Commission's report to the 85th Legislature, the
4444 Sunset Advisory Commission may include any recommendations it
4545 considers appropriate. The review must include an examination of
4646 alternative organizational structures for the Texas Energy
4747 Resources [Railroad] Commission [of Texas] and alternative methods
4848 for performing the commission's responsibilities that would enable
4949 the efficient and effective accomplishment of the commission's
5050 functions. The examination must include an assessment of existing
5151 state agencies that would be able to perform the commission's
5252 functions. The review must also include an examination of methods
5353 to increase the public's role in decisions of the Texas Energy
5454 Resources [Railroad] Commission [of Texas] that relate to the
5555 effect of the growth of resource extraction. The Sunset Advisory
5656 Commission may contract for assistance in performing the review,
5757 including assistance in evaluating, auditing, and forensic
5858 auditing, as the Sunset Advisory Commission determines
5959 necessary. This subsection expires September 1, 2017.
6060 (b) The Texas Energy Resources [Railroad] Commission [of
6161 Texas] shall pay the costs incurred by the Sunset Advisory
6262 Commission in performing a review of the commission under this
6363 section. The Sunset Advisory Commission shall determine the
6464 costs, and the commission shall pay the amount of those costs
6565 promptly on receipt of a statement from the Sunset Advisory
6666 Commission detailing the costs.
6767 SECTION 5. Subchapter B, Chapter 81, Natural Resources
6868 Code, is amended by adding Sections 81.010015, 81.010045, and
6969 81.010046 to read as follows:
7070 Sec. 81.010015. ELECTION AND TERMS OF COMMISSIONERS;
7171 VACANCIES. (a) The commission is composed of three commissioners
7272 elected at the general election for state and county officers.
7373 (b) Commissioners serve staggered terms of six years, with
7474 the term of one commissioner expiring December 31 of each
7575 even-numbered year.
7676 (c) The governor shall appoint a person to fill a vacancy on
7777 the commission until the next general election.
7878 Sec. 81.010045. CERTAIN POLITICAL CONTRIBUTIONS
7979 RESTRICTED. (a) In this section, "political committee" and
8080 "political contribution" have the meanings assigned by Section
8181 251.001, Election Code.
8282 (b) A commissioner may not knowingly accept a political
8383 contribution given or offered with the intention that it be used in
8484 connection with a campaign for or the holding of any elective
8585 office, including the office of commissioner, except during the
8686 period:
8787 (1) beginning 17 months before the date of the next
8888 general election at which the commissioner's office is filled; and
8989 (2) ending on the 30th day after the date of that
9090 election.
9191 (c) A person other than a commissioner may not knowingly
9292 accept a political contribution given or offered with the intention
9393 that it be used in connection with a campaign for the office of
9494 commissioner, except:
9595 (1) during the period:
9696 (A) beginning 17 months before the date of the
9797 next general election at which any commissioner's office is filled;
9898 and
9999 (B) ending on the 30th day after the date of that
100100 election; or
101101 (2) during the period beginning on the date a vacancy
102102 in the office of commissioner occurs and ending on the date that
103103 vacancy is filled.
104104 (d) A commissioner may not knowingly accept a political
105105 contribution, and shall refuse a political contribution that is
106106 received, from a party in a contested case before the commission or
107107 a political committee affiliated with such a party during the
108108 period:
109109 (1) beginning on the date notice of the hearing in the
110110 contested case is given; and
111111 (2) ending on:
112112 (A) the 30th day after the date the decision in
113113 the contested case is rendered; or
114114 (B) if a request for rehearing is filed:
115115 (i) the date the request is denied; or
116116 (ii) the 30th day after the date the
117117 decision after rehearing is rendered.
118118 (e) A commissioner shall return a political contribution
119119 that is received and refused under Subsection (d) not later than the
120120 30th day after the date the commissioner received the contribution.
121121 (f) The commission shall adopt all rules necessary to
122122 implement Subsections (d) and (e), including rules that:
123123 (1) direct the commission to maintain a list of the
124124 contested cases before the commission and the parties to each case
125125 in order to aid the commissioners in complying with those
126126 subsections; and
127127 (2) ensure that each notice of a hearing in a contested
128128 case that is issued by the commission or a commissioner contains
129129 information about the political contributions prohibited under
130130 Subsection (d).
131131 Sec. 81.010046. AUTOMATIC RESIGNATION. If a person who is a
132132 member of the commission announces the person's candidacy, or in
133133 fact becomes a candidate, in a general, special, or primary
134134 election for an elective office other than the office of
135135 commissioner, that announcement or that candidacy constitutes an
136136 automatic resignation of the office of commissioner.
137137 SECTION 6. Section 81.01005, Natural Resources Code, is
138138 amended to read as follows:
139139 Sec. 81.01005. NAME AND SEAL. (a) The commissioners are
140140 known collectively as the "Texas Energy Resources [Railroad]
141141 Commission [of Texas]."
142142 (b) The seal of the commission contains a star of five
143143 points with the words "Texas Energy Resources [Railroad] Commission
144144 [of Texas]" engraved on it.
145145 SECTION 7. The heading to Section 81.0521, Natural
146146 Resources Code, is amended to read as follows:
147147 Sec. 81.0521. FEE FOR APPLICATION FOR EXCEPTION TO
148148 [RAILROAD] COMMISSION RULE.
149149 SECTION 8. Section 52.092(c), Election Code, is amended to
150150 read as follows:
151151 (c) Statewide offices of the state government shall be
152152 listed in the following order:
153153 (1) governor;
154154 (2) lieutenant governor;
155155 (3) attorney general;
156156 (4) comptroller of public accounts;
157157 (5) commissioner of the General Land Office;
158158 (6) commissioner of agriculture;
159159 (7) energy resources [railroad] commissioner;
160160 (8) chief justice, supreme court;
161161 (9) justice, supreme court;
162162 (10) presiding judge, court of criminal appeals;
163163 (11) judge, court of criminal appeals.
164164 SECTION 9. On the effective date of this Act, the name of
165165 the Railroad Commission of Texas is changed to the Texas Energy
166166 Resources Commission. The change of the agency's name does not
167167 affect:
168168 (1) the agency's powers, duties, rights, or
169169 obligations;
170170 (2) the agency's personnel, equipment, data,
171171 documents, facilities, contracts, items, other property,
172172 appropriations, rules, or decisions;
173173 (3) a proceeding of or involving the agency under the
174174 name of the Railroad Commission of Texas; or
175175 (4) the terms of the chairman or other members of the
176176 governing body of the agency.
177177 SECTION 10. This Act takes effect September 1, 2015.
