77 relating to the use of digitized signatures in certain family law
88 proceedings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 1, Family Code, is amended
1111 by adding Section 1.109 to read as follows:
1212 Sec. 1.109. USE OF DIGITIZED SIGNATURE. (a) A digitized
1313 signature on an original petition under this title or any other
1414 pleading or order in a proceeding under this title satisfies the
1515 requirements for and imposes the duties of signatories to
1616 pleadings, motions, and other papers identified under Rule 13,
1717 Texas Rules of Civil Procedure.
1818 (b) A digitized signature under this section may be applied
1919 only by, and must remain under the sole control of, the person whose
2020 signature is represented.
2121 SECTION 2. Title 2, Family Code, is amended by adding
2222 Subtitle E to read as follows:
2323 SUBTITLE E. GENERAL PROVISIONS
2424 CHAPTER 47. GENERAL PROVISIONS
2525 Sec. 47.001. USE OF DIGITIZED SIGNATURE. (a) A digitized
2626 signature on an original petition or application under this title
2727 or any other pleading or order in a proceeding under this title
2828 satisfies the requirements for and imposes the duties of
2929 signatories to pleadings, motions, and other papers identified
3030 under Rule 13, Texas Rules of Civil Procedure.
3131 (b) A digitized signature under this section may be applied
3232 only by, and must remain under the sole control of, the person whose
3333 signature is represented.
3434 (c) In this section, "digitized signature" has the meaning
3535 assigned by Section 101.0096.
3636 SECTION 3. Chapter 81, Family Code, is amended by adding
3737 Section 81.011 to read as follows:
3838 Sec. 81.011. USE OF DIGITIZED SIGNATURE. (a) A digitized
3939 signature on an application for a protective order under this title
4040 or any other pleading or order in a proceeding under this title
4141 satisfies the requirements for and imposes the duties of
4242 signatories to pleadings, motions, and other papers identified
4343 under Rule 13, Texas Rules of Civil Procedure.
4444 (b) A digitized signature under this section may be applied
4545 only by, and must remain under the sole control of, the person whose
4646 signature is represented.
4747 SECTION 4. The changes in law made by this Act apply only to
4848 a proceeding that is commenced on or after the effective date of
4949 this Act. A proceeding that is commenced before that date is
5050 governed by the law in effect on the date the proceeding was
5151 commenced, and the former law is continued in effect for that
5252 purpose.
5353 SECTION 5. This Act takes effect September 1, 2015.
