55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to increasing the criminal penalty for causing certain
88 assaultive physical contact with a child.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 22.01(c), Penal Code, is amended to read
1111 as follows:
1212 (c) An offense under Subsection (a)(2) or (3) is a Class C
1313 misdemeanor, except that the offense is:
1414 (1) a Class A misdemeanor if the offense is committed
1515 under Subsection (a)(3):
1616 (A) against an elderly individual or disabled
1717 individual[, as those terms are defined by Section 22.04]; or
1818 (B) against a child by a person who is 17 years of
1919 age or older at the time of the offense; or
2020 (2) a Class B misdemeanor if the offense is committed
2121 by a person who is not a sports participant against a person the
2222 actor knows is a sports participant either:
2323 (A) while the participant is performing duties or
2424 responsibilities in the participant's capacity as a sports
2525 participant; or
2626 (B) in retaliation for or on account of the
2727 participant's performance of a duty or responsibility within the
2828 participant's capacity as a sports participant.
2929 SECTION 2. Section 22.01(e), Penal Code, is amended by
3030 adding Subdivision (2) to read as follows:
3131 (2) "Child," "disabled individual," and "elderly
3232 individual" have the meanings assigned by Section 22.04.
3333 SECTION 3. The change in law made by this Act applies only
3434 to an offense committed on or after the effective date of this Act.
3535 An offense committed before the effective date of this Act is
3636 governed by the law in effect on the date the offense was committed,
3737 and the former law is continued in effect for that purpose. For
3838 purposes of this section, an offense was committed before the
3939 effective date of this Act if any element of the offense occurred
4040 before that date.
4141 SECTION 4. This Act takes effect September 1, 2015.
