| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 1369, Insurance Code, is |
|---|
| 11 | 11 | | amended by adding Section 1369.058 to read as follows: |
|---|
| 12 | 12 | | Sec. 1369.058. PAYMENT FOR REFILLS. A health benefit plan |
|---|
| 13 | 13 | | issuer may not deny benefits for a refill, regardless of whether the |
|---|
| 14 | 14 | | refill is early, of a prescription drug that is covered under the |
|---|
| 15 | 15 | | plan and for which benefits have previously been paid under the plan |
|---|
| 16 | 16 | | if the quantity limit, if applicable, for the drug has not been |
|---|
| 17 | 17 | | exceeded after the refill. |
|---|
| 18 | 18 | | SECTION 2. Section 1369.058, Insurance Code, as added by |
|---|
| 19 | 19 | | this Act, applies only to a health benefit plan that is delivered, |
|---|
| 20 | 20 | | issued for delivery, or renewed on or after January 1, 2016. A |
|---|
| 21 | 21 | | health benefit plan delivered, issued for delivery, or renewed |
|---|
| 22 | 22 | | before January 1, 2016, is governed by the law in effect as it |
|---|
| 23 | 23 | | existed immediately before the effective date of this Act, and that |
|---|
| 24 | 24 | | law is continued in effect for that purpose. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2015. |
