| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 21.202, Labor Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (a) A complaint under this subchapter must be filed not |
|---|
| 17 | 17 | | later than the earlier of: |
|---|
| 18 | 18 | | (1) the 180th day after the date the complainant |
|---|
| 19 | 19 | | discovered the alleged unlawful employment practice; or |
|---|
| 20 | 20 | | (2) the fifth anniversary of the date the alleged |
|---|
| 21 | 21 | | unlawful employment practice occurred. |
|---|
| 22 | 22 | | (c) For purposes of Subsection (a), with respect to a |
|---|
| 23 | 23 | | complaint based on the payment of wages, an unlawful employment |
|---|
| 24 | 24 | | practice does not occur each time wages affected wholly or partly by |
|---|
| 25 | 25 | | the practice are paid. |
|---|
| 26 | 26 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 27 | 27 | | an unlawful employment practice that occurs on or after the |
|---|
| 28 | 28 | | effective date of this Act. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2015. |
