| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 42, Education Code, is | |
| 11 | 11 | amended by adding Section 42.161 to read as follows: | |
| 12 | 12 | Sec. 42.161. WINDSTORM AND HAIL INSURANCE ALLOTMENT. (a) A | |
| 13 | 13 | school district that contracts for windstorm and hail insurance is | |
| 14 | 14 | entitled to receive an allotment equal to the total amount required | |
| 15 | 15 | to be paid for the insurance, not to exceed an amount specified by | |
| 16 | 16 | commissioner rule. | |
| 17 | 17 | (b) The commissioner may provide the allotment under this | |
| 18 | 18 | section only if funds are specifically appropriated for that | |
| 19 | 19 | purpose or the commissioner determines that the amount appropriated | |
| 20 | 20 | for purposes of the Foundation School Program exceeds the amount to | |
| 21 | 21 | which school districts are entitled under this chapter and the | |
| 22 | 22 | excess funds may be used for that purpose. | |
| 23 | 23 | SECTION 2. This Act takes effect September 1, 2015. |
