| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Chapter 199, Transportation Code, is amended by | |
| 12 | 12 | adding Section 199.003 to read as follows: | |
| 13 | 13 | Sec. 199.003. NOTICE OF ELECTRIC RAILWAY PROJECT. If the | |
| 14 | 14 | department is notified of an application submitted to the federal | |
| 15 | 15 | Surface Transportation Board for an electric railway project in | |
| 16 | 16 | this state or receives a notice of intent to prepare an | |
| 17 | 17 | environmental impact statement for an electric railway project in | |
| 18 | 18 | this state, the department shall provide notification of the | |
| 19 | 19 | application or notice to each state senator, state representative, | |
| 20 | 20 | and county judge who represents a district or county, as | |
| 21 | 21 | applicable, that could be directly affected by the project. | |
| 22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2015. |
