244 AN ACT
255 relating to the provision of telemedicine medical services in a
266 school-based setting, including the reimbursement of providers
277 under the Medicaid program for those services.
288 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
299 SECTION 1. Section 531.0217, Government Code, is amended by
3010 adding Subsections (c-4) and (g-1) and amending Subsection (g) to
3111 read as follows:
3212 (c-4) The commission shall ensure that Medicaid
3313 reimbursement is provided to a physician for a telemedicine medical
3414 service provided by the physician, even if the physician is not the
3515 patient's primary care physician or provider, if:
3616 (1) the physician is an authorized health care
3717 provider under Medicaid;
3818 (2) the patient is a child who receives the service in
3919 a primary or secondary school-based setting;
4020 (3) the parent or legal guardian of the patient
4121 provides consent before the service is provided; and
4222 (4) a health professional is present with the patient
4323 during the treatment.
4424 (g) If a patient receiving a telemedicine medical service
4525 has a primary care physician or provider and consents or, if
4626 appropriate, the patient's parent or legal guardian consents to the
4727 notification, the commission shall require that the primary care
4828 physician or provider be notified of the telemedicine medical
4929 service for the purpose of sharing medical information. In the case
5030 of a service provided to a child in a school-based setting as
5131 described by Subsection (c-4), the notification, if any, must
5232 include a summary of the service, including exam findings,
5333 prescribed or administered medications, and patient instructions.
5434 (g-1) If a patient receiving a telemedicine medical service
5535 in a school-based setting as described by Subsection (c-4) does not
5636 have a primary care physician or provider, the commission shall
5737 require that the patient's parent or legal guardian receive:
5838 (1) the notification required under Subsection (g);
5939 and
6040 (2) a list of primary care physicians or providers
6141 from which the patient may select the patient's primary care
6242 physician or provider.
6343 SECTION 2. If before implementing any provision of this Act
6444 a state agency determines that a waiver or authorization from a
6545 federal agency is necessary for implementation of that provision,
6646 the agency affected by the provision shall request the waiver or
6747 authorization and may delay implementing that provision until the
6848 waiver or authorization is granted.
6949 SECTION 3. This Act takes effect September 1, 2015.
