66 AN ACT
77 relating to notice requirements for certain witnesses who are
88 scheduled to appear before a grand jury.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 20, Code of Criminal Procedure, is
1111 amended by adding Article 20.125 to read as follows:
1212 Art. 20.125. NOTICE REQUIREMENT. A witness, including a
1313 witness who is an accused or suspected person, who does not receive
1414 a grant of immunity from prosecution in exchange for the witness's
1515 testimony before a grand jury is entitled to receive notice that the
1616 witness is scheduled to appear before the grand jury not later than
1717 the 10th day before the date that any appearance before the grand
1818 jury is required, unless the notice is waived by the witness.
1919 SECTION 2. The change in law made by this Act applies only
2020 to a grand jury proceeding that begins on or after the effective
2121 date of this Act. A grand jury proceeding that begins before the
2222 effective date of this Act is governed by the law in effect on the
2323 date the proceeding began, and the former law is continued in effect
2424 for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2015.
