9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Chapter 20, Code of Criminal Procedure, is | |
11 | 11 | amended by adding Article 20.125 to read as follows: | |
12 | 12 | Art. 20.125. NOTICE REQUIREMENT. A witness, including a | |
13 | 13 | witness who is an accused or suspected person, who does not receive | |
14 | 14 | a grant of immunity from prosecution in exchange for the witness's | |
15 | 15 | testimony before a grand jury is entitled to receive notice that the | |
16 | 16 | witness is scheduled to appear before the grand jury not later than | |
17 | 17 | the 10th day before the date that any appearance before the grand | |
18 | 18 | jury is required, unless the notice is waived by the witness. | |
19 | 19 | SECTION 2. The change in law made by this Act applies only | |
20 | 20 | to a grand jury proceeding that begins on or after the effective | |
21 | 21 | date of this Act. A grand jury proceeding that begins before the | |
22 | 22 | effective date of this Act is governed by the law in effect on the | |
23 | 23 | date the proceeding began, and the former law is continued in effect | |
24 | 24 | for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2015. |
