55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to enhancing the penalties for certain repeat and habitual
88 misdemeanor offenders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.43, Penal Code, is amended by
1111 amending Subsections (a) and (b) and adding Subsection (b-1) to
1212 read as follows:
1313 (a) If it is shown on the trial of a Class A misdemeanor that
1414 the defendant has been previously [before] convicted one time of a
1515 Class A misdemeanor or any degree of felony, on conviction the
1616 defendant [he] shall be punished by:
1717 (1) a fine not to exceed $4,000;
1818 (2) confinement in jail for any term of not more than
1919 one year or less than 90 days; or
2020 (3) both such fine and confinement.
2121 (b) If it is shown on the trial of a Class B misdemeanor that
2222 the defendant has been previously [before] convicted one time of a
2323 Class A or Class B misdemeanor or any degree of felony, on
2424 conviction the defendant [he] shall be punished by:
2525 (1) a fine not to exceed $2,000;
2626 (2) confinement in jail for any term of not more than
2727 180 days or less than 30 days; or
2828 (3) both such fine and confinement.
2929 (b-1) If it is shown on the trial of a Class A or Class B
3030 misdemeanor that the defendant has been previously convicted two or
3131 more times of a Class A or Class B misdemeanor or any degree of
3232 felony, on conviction the defendant shall be punished by:
3333 (1) a fine of not more than $4,000 and not less than
3434 $2,000;
3535 (2) confinement in jail for any term of not more than
3636 one year or less than 180 days; or
3737 (3) both such fine and confinement.
3838 SECTION 2. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 3. This Act takes effect September 1, 2015.
