| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 49.09, Penal Code, is amended by adding |
|---|
| 13 | 13 | | Subsection (i) to read as follows: |
|---|
| 14 | 14 | | (i) A conviction may not be used for purposes of enhancement |
|---|
| 15 | 15 | | under this section if the conviction was for an offense under |
|---|
| 16 | 16 | | Section 49.04, 49.045, 49.05, 49.06, or 49.065 that was committed |
|---|
| 17 | 17 | | more than 10 years before the date on which the offense for which |
|---|
| 18 | 18 | | the person is being tried was committed. |
|---|
| 19 | 19 | | SECTION 2. The change in law made by this Act applies to an |
|---|
| 20 | 20 | | offense committed on or after the effective date of this Act and to |
|---|
| 21 | 21 | | any criminal action pending on the effective date of this Act for an |
|---|
| 22 | 22 | | offense committed before that effective date. A final conviction |
|---|
| 23 | 23 | | for an offense punished under Section 49.09, Penal Code, that |
|---|
| 24 | 24 | | exists on the effective date of this Act is unaffected by this Act. |

| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2015. |
