77 relating to the indexing of correction instruments in a county
88 index to real property records.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 193.003, Local Government Code, is
1111 amended by amending Subsections (a) and (b) and adding Subsection
1212 (d) to read as follows:
1313 (a) The county clerk shall maintain an [a well-bound]
1414 alphabetical index to all recorded deeds, powers of attorney,
1515 mortgages, correction instruments, and other instruments relating
1616 to real property. The index must state the specific location in the
1717 records at which the instruments are recorded.
1818 (b) The index must be a cross-index that contains the names
1919 of the grantors and grantees in alphabetical order. If a deed is
2020 made by a sheriff, the index entry must contain the name of the
2121 sheriff and the defendant in execution. If a deed is made by an
2222 executor, administrator, or guardian, the index entry must contain
2323 the name of that person and the name of the person's testator,
2424 intestate, or ward. If a deed is made by an attorney, the index
2525 entry must contain the name of the attorney and the attorney's
2626 constituents. If a deed is made by a commissioner or trustee, the
2727 index entry must contain the name of the commissioner or trustee and
2828 the name of the person whose estate is conveyed. The index entry
2929 for a correction instrument must contain the names of the grantors
3030 and grantees as stated in the correction instrument.
3131 (d) In this section, "correction instrument" means an
3232 instrument correcting an ambiguity or error in a recorded original
3333 instrument of conveyance to transfer real property or an interest
3434 in real property as described by Section 5.028 or 5.029, Property
3535 Code.
3636 SECTION 2. This Act takes effect September 1, 2015.
