55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to grants awarded by the Cancer Prevention and Research
88 Institute of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 102.251, Health and Safety Code, is
1111 amended by amending Subsection (a) and adding Subsection (f) to
1212 read as follows:
1313 (a) The oversight committee shall issue rules regarding the
1414 procedure for awarding grants to an applicant under this chapter.
1515 The rules must include the following procedures:
1616 (1) a research and prevention programs committee shall
1717 score grant applications and make recommendations to the program
1818 integration committee, established under Section 102.264, and the
1919 oversight committee regarding the award of cancer research and
2020 prevention grants, including a prioritized list that:
2121 (A) ranks the grant applications in the order the
2222 committee determines applications should be funded; and
2323 (B) includes information explaining how each
2424 grant application on the list meets the research and prevention
2525 programs committee's standards for recommendation;
2626 (2) the program integration committee shall submit to
2727 the oversight committee a list of grant applications the program
2828 integration committee by majority vote approved for recommendation
2929 that:
3030 (A) includes documentation on the factors the
3131 program integration committee considered in making the grant
3232 recommendations;
3333 (B) is substantially based on the list submitted
3434 by the research and prevention programs committee under Subdivision
3535 (1); and
3636 (C) to the extent possible, gives priority to
3737 proposals that:
3838 (i) could lead to immediate or long-term
3939 medical and scientific breakthroughs in the area of cancer
4040 prevention or cures for cancer;
4141 (ii) strengthen and enhance fundamental
4242 science in cancer research;
4343 (iii) ensure a comprehensive coordinated
4444 approach to cancer research;
4545 (iv) are interdisciplinary or
4646 interinstitutional;
4747 (v) address federal or other major research
4848 sponsors' priorities in emerging scientific or technology fields in
4949 the area of cancer prevention or cures for cancer;
5050 (vi) are matched with funds available by a
5151 private or nonprofit entity and institution or institutions of
5252 higher education;
5353 (vii) are collaborative between any
5454 combination of private and nonprofit entities, public or private
5555 agencies or institutions in this state, and public or private
5656 institutions outside this state;
5757 (viii) have a demonstrable economic
5858 development benefit to this state;
5959 (ix) enhance research superiority at
6060 institutions of higher education in this state by creating new
6161 research superiority, attracting existing research superiority
6262 from institutions not located in this state and other research
6363 entities, or enhancing existing research superiority by attracting
6464 from outside this state additional researchers and resources;
6565 (x) [expedite innovation and product
6666 development, attract, create, or expand private sector entities
6767 that will drive a substantial increase in high-quality jobs, and]
6868 increase higher education applied science or technology research
6969 capabilities; and
7070 (xi) address the goals of the Texas Cancer
7171 Plan; and
7272 (3) the institute's chief compliance officer shall
7373 compare each grant application submitted to the institute to a list
7474 of donors from any nonprofit organization established to provide
7575 support to the institute compiled from information made available
7676 under Section 102.262(c) before the application is submitted to a
7777 research and prevention programs committee for review and again
7878 before any grant is awarded to the applicant.
7979 (f) The institute may not award a grant for the purpose of
8080 expediting innovation and product development of a private sector
8181 entity, or to attract, create, or expand a private sector entity.
8282 SECTION 2. (a) As soon as practicable after the effective
8383 date of this Act, the Cancer Prevention and Research Institute of
8484 Texas Oversight Committee shall adopt the rules necessary to
8585 implement the changes in law made by this Act.
8686 (b) The changes in law made by this Act apply to a grant
8787 awarded by the Cancer Prevention and Research Institute of Texas on
8888 or after the effective date of this Act, regardless of whether the
8989 grant application was submitted before, on, or after the effective
9090 date of this Act.
9191 SECTION 3. This Act takes effect immediately if it receives
9292 a vote of two-thirds of all the members elected to each house, as
9393 provided by Section 39, Article III, Texas Constitution. If this
9494 Act does not receive the vote necessary for immediate effect, this
9595 Act takes effect September 1, 2015.
