7 | 7 | | relating to grants awarded by the Cancer Prevention and Research |

8 | 8 | | Institute of Texas. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 102.251, Health and Safety Code, is |
---|
11 | 11 | | amended by amending Subsection (a) and adding Subsection (f) to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (a) The oversight committee shall issue rules regarding the |
---|
14 | 14 | | procedure for awarding grants to an applicant under this chapter. |
---|
15 | 15 | | The rules must include the following procedures: |
---|
16 | 16 | | (1) a research and prevention programs committee shall |
---|
17 | 17 | | score grant applications and make recommendations to the program |
---|
18 | 18 | | integration committee, established under Section 102.264, and the |
---|
19 | 19 | | oversight committee regarding the award of cancer research and |
---|
20 | 20 | | prevention grants, including a prioritized list that: |
---|
21 | 21 | | (A) ranks the grant applications in the order the |
---|
22 | 22 | | committee determines applications should be funded; and |
---|
23 | 23 | | (B) includes information explaining how each |
---|
24 | 24 | | grant application on the list meets the research and prevention |
---|
25 | 25 | | programs committee's standards for recommendation; |
---|
26 | 26 | | (2) the program integration committee shall submit to |
---|
27 | 27 | | the oversight committee a list of grant applications the program |
---|
28 | 28 | | integration committee by majority vote approved for recommendation |
---|
29 | 29 | | that: |
---|
30 | 30 | | (A) includes documentation on the factors the |
---|
31 | 31 | | program integration committee considered in making the grant |
---|
32 | 32 | | recommendations; |
---|
33 | 33 | | (B) is substantially based on the list submitted |
---|
34 | 34 | | by the research and prevention programs committee under Subdivision |
---|
35 | 35 | | (1); and |
---|
36 | 36 | | (C) to the extent possible, gives priority to |
---|
37 | 37 | | proposals that: |
---|
38 | 38 | | (i) could lead to immediate or long-term |
---|
39 | 39 | | medical and scientific breakthroughs in the area of cancer |
---|
40 | 40 | | prevention or cures for cancer; |
---|
41 | 41 | | (ii) strengthen and enhance fundamental |
---|
42 | 42 | | science in cancer research; |
---|
43 | 43 | | (iii) ensure a comprehensive coordinated |
---|
44 | 44 | | approach to cancer research; |
---|
45 | 45 | | (iv) are interdisciplinary or |
---|
46 | 46 | | interinstitutional; |
---|
47 | 47 | | (v) address federal or other major research |
---|
48 | 48 | | sponsors' priorities in emerging scientific or technology fields in |
---|
49 | 49 | | the area of cancer prevention or cures for cancer; |
---|
50 | 50 | | (vi) are matched with funds available by a |
---|
51 | 51 | | private or nonprofit entity and institution or institutions of |
---|
52 | 52 | | higher education; |
---|
53 | 53 | | (vii) are collaborative between any |
---|
54 | 54 | | combination of private and nonprofit entities, public or private |
---|
55 | 55 | | agencies or institutions in this state, and public or private |
---|
56 | 56 | | institutions outside this state; |
---|
57 | 57 | | (viii) have a demonstrable economic |
---|
58 | 58 | | development benefit to this state; |
---|
59 | 59 | | (ix) enhance research superiority at |
---|
60 | 60 | | institutions of higher education in this state by creating new |
---|
61 | 61 | | research superiority, attracting existing research superiority |
---|
62 | 62 | | from institutions not located in this state and other research |
---|
63 | 63 | | entities, or enhancing existing research superiority by attracting |
---|
64 | 64 | | from outside this state additional researchers and resources; |
---|
65 | 65 | | (x) [expedite innovation and product |
---|
66 | 66 | | development, attract, create, or expand private sector entities |
---|
67 | 67 | | that will drive a substantial increase in high-quality jobs, and] |
---|
68 | 68 | | increase higher education applied science or technology research |
---|
69 | 69 | | capabilities; and |
---|
70 | 70 | | (xi) address the goals of the Texas Cancer |
---|
71 | 71 | | Plan; and |
---|
72 | 72 | | (3) the institute's chief compliance officer shall |
---|
73 | 73 | | compare each grant application submitted to the institute to a list |
---|
74 | 74 | | of donors from any nonprofit organization established to provide |
---|
75 | 75 | | support to the institute compiled from information made available |
---|
76 | 76 | | under Section 102.262(c) before the application is submitted to a |
---|
77 | 77 | | research and prevention programs committee for review and again |
---|
78 | 78 | | before any grant is awarded to the applicant. |
---|
79 | 79 | | (f) The institute may not award a grant for the purpose of |
---|
80 | 80 | | expediting innovation and product development of a private sector |
---|
81 | 81 | | entity, or to attract, create, or expand a private sector entity. |
---|
82 | 82 | | SECTION 2. (a) As soon as practicable after the effective |
---|
83 | 83 | | date of this Act, the Cancer Prevention and Research Institute of |
---|
84 | 84 | | Texas Oversight Committee shall adopt the rules necessary to |
---|
85 | 85 | | implement the changes in law made by this Act. |
---|
86 | 86 | | (b) The changes in law made by this Act apply to a grant |
---|
87 | 87 | | awarded by the Cancer Prevention and Research Institute of Texas on |
---|
88 | 88 | | or after the effective date of this Act, regardless of whether the |
---|
89 | 89 | | grant application was submitted before, on, or after the effective |
---|
90 | 90 | | date of this Act. |
---|
91 | 91 | | SECTION 3. This Act takes effect immediately if it receives |
---|
92 | 92 | | a vote of two-thirds of all the members elected to each house, as |
---|
93 | 93 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
94 | 94 | | Act does not receive the vote necessary for immediate effect, this |
---|
95 | 95 | | Act takes effect September 1, 2015. |
