| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 223.201(j), Transportation Code, is |
|---|
| 14 | 14 | | amended to read as follows: |
|---|
| 15 | 15 | | (j) Before the department may enter into a comprehensive |
|---|
| 16 | 16 | | development agreement under Subsection (f), the department must: |
|---|
| 17 | 17 | | (1) for a project other than the State Highway 99 |
|---|
| 18 | 18 | | (Grand Parkway) project, obtain, not later than August 31, 2019 |
|---|
| 19 | 19 | | [2017], the appropriate environmental clearance: |
|---|
| 20 | 20 | | (A) for the project; or |
|---|
| 21 | 21 | | (B) for the initial or base scope of the project |
|---|
| 22 | 22 | | if the project agreement provides for the phased construction of |
|---|
| 23 | 23 | | the project; and |
|---|
| 24 | 24 | | (2) present to the commission a full financial plan |
|---|
| 25 | 25 | | for the project, including costing methodology and cost proposals. |
|---|
| 26 | 26 | | SECTION 2. Sections 223.2011(a), (c), and (f), |
|---|
| 27 | 27 | | Transportation Code, are amended to read as follows: |
|---|
| 28 | 28 | | (a) Notwithstanding Sections 223.201(f) and 370.305(c), the |
|---|
| 29 | 29 | | department or an authority under Section 370.003 may enter into one |
|---|
| 30 | 30 | | or more [a] comprehensive development agreements [agreement] |
|---|
| 31 | 31 | | relating to improvements to, or construction of, all or part of: |
|---|
| 32 | 32 | | (1) the Loop 1 (MoPac Improvement) project from |
|---|
| 33 | 33 | | Farm-to-Market Road 734 to Cesar Chavez Street; |
|---|
| 34 | 34 | | (2) the U.S. 183 (Bergstrom Expressway) project from |
|---|
| 35 | 35 | | Springdale Road to Patton Avenue; |
|---|
| 36 | 36 | | (3) a project or projects consisting of the |
|---|
| 37 | 37 | | construction of: |
|---|
| 38 | 38 | | (A) the Outer Parkway Project in Cameron County |
|---|
| 39 | 39 | | from U.S. Highway 77 to Farm-to-Market Road 1847; [and] |
|---|
| 40 | 40 | | (B) the South Padre Island Second Access Causeway |
|---|
| 41 | 41 | | Project from State Highway 100 to Park Road 100; and |

| 42 | 42 | | (C) the Farm-to-Market Road 106 project in |

| 59 | 59 | | (c) Not later than December 1, 2016 [2014], the department |
|---|
| 60 | 60 | | or the authority, as applicable, shall provide a report to the |
|---|
| 61 | 61 | | commission on the status of a project described by Subsection |
|---|
| 62 | 62 | | (a). The report must include: |
|---|
| 63 | 63 | | (1) the status of the project's environmental |
|---|
| 64 | 64 | | clearance; |
|---|
| 65 | 65 | | (2) an explanation of any project delays; and |
|---|
| 66 | 66 | | (3) if the procurement is not completed, the |
|---|
| 67 | 67 | | anticipated date for the completion of the procurement. |
|---|
| 68 | 68 | | (f) The authority to enter into a comprehensive development |
|---|
| 69 | 69 | | agreement under this section expires August 31, 2019 [2017]. |
|---|
| 70 | 70 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 71 | 71 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 72 | 72 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 73 | 73 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 74 | 74 | | Act takes effect September 1, 2015. |
