55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the carrying of concealed handguns by certain persons
88 attending a school board meeting.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 46.03, Penal Code, is amended by adding
1111 Subsection (j) to read as follows:
1212 (j) It is a defense to prosecution under Subsection (a)(1)
1313 that at the time of the commission of the offense the actor was:
1414 (1) carrying a concealed handgun that the person was
1515 licensed to carry under Subchapter H, Chapter 411, Government Code;
1616 and
1717 (2) attending a school board meeting in an official
1818 capacity as:
1919 (A) a member of the school board; or
2020 (B) the superintendent of the school governed by
2121 the school board.
2222 SECTION 2. Section 46.035, Penal Code, is amended by adding
2323 Subsection (l) to read as follows:
2424 (l) It is a defense to prosecution under Subsection (c) that
2525 at the time of the commission of the offense the actor was attending
2626 a school board meeting in an official capacity as:
2727 (1) a member of the school board; or
2828 (2) the superintendent of the school governed by the
2929 school board.
3030 SECTION 3. The change in law made by this Act applies only
3131 to an offense committed on or after the effective date of this Act.
3232 An offense committed before the effective date of this Act is
3333 governed by the law in effect on the date the offense was committed,
3434 and the former law is continued in effect for that purpose. For
3535 purposes of this section, an offense was committed before the
3636 effective date of this Act if any element of the offense occurred
3737 before that date.
3838 SECTION 4. This Act takes effect September 1, 2015.
