66 AN ACT
77 relating to the recommendations made by the Sunset Advisory
88 Commission regarding state agencies reviewed under the Texas Sunset
99 Act.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 325.012, Government Code, is amended by
1212 adding Subsection (a-1) to read as follows:
1313 (a-1) In its report on a state agency under Subsection (a),
1414 the commission may only make recommendations that relate to
1515 procedural changes in the day-to-day operation or function of the
1616 state agency, including recommendations related to internal
1717 business operating procedures of the agency and administrative
1818 functions that do not require or are not affected by the unique
1919 subject matter responsibilities of the agency, such as changes to
2020 the general employment policy, the career ladder program, equal
2121 opportunity policies, public interest information and public
2222 participation policies, and the procedural method for issuing a
2323 license or resolving a complaint. The commission may not make
2424 recommendations that relate to substantive changes in the operation
2525 or function of the agency, including recommendations related to:
2626 (1) the expansion or contraction of the subject matter
2727 responsibilities of the agency;
2828 (2) a restriction on the deliberative process of a
2929 state agency's governing board;
3030 (3) a change to the qualifications for a license or the
3131 activities for which a license issued by the agency is required;
3232 (4) a change to the rulemaking authority of the agency
3333 as it relates to the agency's enforcement of its subject matter;
3434 (5) a change to the scope of practice of the holder of
3535 a license issued by the agency; and
3636 (6) agency penalty and enforcement provisions.
3737 SECTION 2. This Act takes effect September 1, 2015.
