| 13 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 8 | | SECTION 1. Section 2157.068, Government Code, is amended by |
|---|
| 15 | 9 | | adding Subsection (j) to read as follows: |
|---|
| 16 | 10 | | (j) The following entities may purchase commodity items |
|---|
| 17 | 11 | | through the department, and be charged a reasonable administrative |
|---|
| 18 | 12 | | fee, as provided by this section: |
|---|
| 19 | 13 | | (1) the Electric Reliability Council of Texas; |
|---|
| 20 | 14 | | (2) the Lower Colorado River Authority; |
|---|
| 21 | 15 | | (3) a private school, as defined by Section 5.001, |
|---|
| 22 | 16 | | Education Code; |
|---|
| 23 | 17 | | (4) a private or independent institution of higher |
|---|
| 24 | 18 | | education, as defined by Section 61.003, Education Code; or |
|---|
| 25 | 19 | | (5) a volunteer fire department, as defined by Section |
|---|
| 26 | 20 | | 152.001, Tax Code. |

| 27 | 21 | | SECTION 2. This Act takes effect September 1, 2015. |
