55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the applicability of the law governing the mineral use
88 of subdivided land.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 92.002(3), Natural Resources Code, is
1111 amended to read as follows:
1212 (3) "Qualified subdivision" means a tract of land of
1313 not more than 640 acres:
1414 (A) that is located:
1515 (i) in a county with [having] a population
1616 of more than 100,000; or
1717 (ii) [in excess of 400,000, or in a county
1818 having a population in excess of 140,000 that borders a county
1919 having a population in excess of 400,000 or located] on a barrier
2020 island;
2121 (B) that has been subdivided in a manner
2222 authorized by law by the surface owners for residential,
2323 commercial, or industrial use; and
2424 (C) that contains an operations site for each
2525 separate 80 acres within the 640-acre tract and provisions for road
2626 and pipeline easements to allow use of the operations site.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2015.
