6	5		AN ACT
7	6		relating to fees imposed by a county for licensing a junkyard or
8	7		automotive wrecking and salvage yard.
9	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	9		SECTION 1. Section 396.041(c), Transportation Code, is
11	10		amended to read as follows:
12	11		(c) An ordinance may:
13	12		(1) impose a fee for the issuance or renewal of a
14	13		license in an amount:
15	14		(A) of $25, if the ordinance is adopted by the
16	15		commissioners court of a county not described by Paragraph (B),
17	16		(C), or (D) [for the issuance or renewal of a license];
18	17		(B) [(2) impose a fee] of not more than[:
19	18		[(A)] $150 [for the issuance or renewal of a
20	19		license], if the ordinance is adopted by the commissioners court of
21	20		a county with a population of one million or more that contains two
22	21		or more municipalities, each of which has a population of 250,000 or
23	22		more; [or]
24	23		(C) of not more than [(B)] $500 [for the
25	24		issuance or renewal of a license], if the ordinance is adopted by
26	25		the commissioners court of a county with a population of 3.3 million
27	26		or more; or
28	27		(D) necessary to pay for the administration and
29		-	enforcement of the ordinance, if the ordinance is adopted by the
30		-	commissioners court of a county with a population of less than one
31		-	million;
	28	+	enforcement of the ordinance, but not to exceed $150, if the
	29	+	ordinance is adopted by the commissioners court of a county located
	30	+	on the Texas-Mexico border that has a population of less than
	31	+	300,000 and contains one or more municipalities with a population
	32	+	of 200,000 or more
	33	+	;
32	34		(2) [(3)] condition the license on the operation of
33	35		the junkyard or automotive wrecking and salvage yard only at a
34	36		location approved by the commissioners court; or
35	37		(3) [(4)] establish grounds for suspending or
36	38		revoking a license if the junkyard or automotive wrecking and
37	39		salvage yard is not screened.
38	40		SECTION 2. This Act takes effect September 1, 2015.
