66 AN ACT
77 relating to recovery of attorney's fees against veterinarians for
88 certain claims.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.006, Civil Practice and Remedies
1111 Code, is amended to read as follows:
1212 Sec. 38.006. EXCEPTIONS. (a) This chapter does not apply
1313 to a contract issued by an insurer that is subject to the provisions
1414 of:
1515 (1) Title 11, Insurance Code;
1616 (2) Chapter 541, Insurance Code;
1717 (3) the Unfair Claim Settlement Practices Act
1818 (Subchapter A, Chapter 542, Insurance Code); or
1919 (4) Subchapter B, Chapter 542, Insurance Code.
2020 (b) A person may not recover attorney's fees against a
2121 veterinarian licensed under Chapter 801, Occupations Code, in a
2222 claim for killed or injured stock resulting from veterinary
2323 malpractice or negligence.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a cause of action that accrues on or after the effective date of
2626 this Act. A cause of action that accrues before the effective date
2727 of this Act is governed by the law applicable to the cause of action
2828 immediately before the effective date of this Act, and that law is
2929 continued in effect for that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2015.
