66 AN ACT
77 relating to permissible locations of open-enrollment charter
88 schools created by institutions of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.152, Education Code, is amended to
1111 read as follows:
1212 Sec. 12.152. AUTHORIZATION. In accordance with this
1313 subchapter and Subchapter D, the commissioner may grant a charter
1414 on the application of:
1515 (1) a public senior college or university for an
1616 open-enrollment charter school to operate on the campus of the
1717 public senior college or university or at another location in any
1818 county in this state [in the same county in which the campus of the
1919 public senior college or university is located]; or
2020 (2) a public junior college for an open-enrollment
2121 charter school to operate on the campus of the public junior college
2222 or at another location in any county in this state [in the same
2323 county in which the campus of the public junior college is located].
2424 SECTION 2. Section 12.152, Education Code, as amended by
2525 this Act:
2626 (1) applies to an application for a new charter
2727 pending on or submitted on or after the effective date of this Act;
2828 and
2929 (2) authorizes the holder of a charter granted before
3030 the effective date of this Act to operate a charter school at a
3131 location in any county of this state, provided that if the charter
3232 holder seeks to operate an additional campus and the commissioner's
3333 approval of the expansion is required under Chapter 12, Education
3434 Code, the charter holder must obtain the commissioner's approval.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2015.
