| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.152, Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 12.152. AUTHORIZATION. In accordance with this |
|---|
| 13 | 13 | | subchapter and Subchapter D, the commissioner may grant a charter |
|---|
| 14 | 14 | | on the application of: |
|---|
| 15 | 15 | | (1) a public senior college or university for an |
|---|
| 16 | 16 | | open-enrollment charter school to operate on the campus of the |
|---|
| 17 | 17 | | public senior college or university or at another location in any |
|---|
| 18 | 18 | | county in this state [in the same county in which the campus of the |
|---|
| 19 | 19 | | public senior college or university is located]; or |
|---|
| 20 | 20 | | (2) a public junior college for an open-enrollment |
|---|
| 21 | 21 | | charter school to operate on the campus of the public junior college |
|---|
| 22 | 22 | | or at another location in any county in this state [in the same |
|---|
| 23 | 23 | | county in which the campus of the public junior college is located]. |

| 24 | 24 | | SECTION 2. Section 12.152, Education Code, as amended by |
|---|
| 25 | 25 | | this Act: |
|---|
| 26 | 26 | | (1) applies to an application for a new charter |
|---|
| 27 | 27 | | pending on or submitted on or after the effective date of this Act; |
|---|
| 28 | 28 | | and |
|---|
| 29 | 29 | | (2) authorizes the holder of a charter granted before |
|---|
| 30 | 30 | | the effective date of this Act to operate a charter school at a |
|---|
| 31 | 31 | | location in any county of this state, provided that if the charter |
|---|
| 32 | 32 | | holder seeks to operate an additional campus and the commissioner's |
|---|
| 33 | 33 | | approval of the expansion is required under Chapter 12, Education |
|---|
| 34 | 34 | | Code, the charter holder must obtain the commissioner's approval. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2015. |
