11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 1702.109, Occupations Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | Sec. 1702.109. GUARD DOG COMPANY. A person acts as a guard |
---|
15 | 15 | | dog company for the purposes of this chapter if the person places, |
---|
16 | 16 | | rents, or sells [, or trains] a dog used to: |
---|
17 | 17 | | (1) protect an individual or property; or |
---|
18 | 18 | | (2) conduct an investigation. |
---|
19 | 19 | | SECTION 2. Section 1702.221(b), Occupations Code, is |
---|
20 | 20 | | amended to read as follows: |
---|
21 | 21 | | (b) An individual must obtain the appropriate endorsement |
---|
22 | 22 | | in accordance with the requirements of this chapter and related |
---|
23 | 23 | | administrative rules if the individual: |
---|
24 | 24 | | (1) is employed as: |
---|
25 | 25 | | (A) an alarm instructor; |
---|
26 | 26 | | (B) an alarm systems installer; |
---|
27 | 27 | | (C) an alarm systems monitor; |
---|
28 | 28 | | (D) an electronic access control device |
---|
29 | 29 | | installer; |
---|
30 | 30 | | (E) a level 3 classroom or firearm instructor; |
---|
31 | 31 | | (F) a locksmith; |
---|
32 | 32 | | (G) [a dog trainer; |
---|
33 | 33 | | [(H)] a manager or branch office manager; |
---|
34 | 34 | | (H) [(I)] a noncommissioned security officer; |
---|
35 | 35 | | (I) [(J)] a level 4 personal protection |
---|
36 | 36 | | instructor; |
---|
37 | 37 | | (J) [(K)] a private investigator; |
---|
38 | 38 | | (K) [(L)] a private security consultant; |
---|
39 | 39 | | (L) [(M)] a security salesperson; or |
---|
40 | 40 | | (M) [(N)] an individual whose duties include |
---|
41 | 41 | | performing another activity for which an endorsement is required |
---|
42 | 42 | | under Subsection (e); or |
---|
43 | 43 | | (2) is an owner who oversees the security-related |
---|
44 | 44 | | aspects of the business, officer, partner, or shareholder of a |
---|
45 | 45 | | license holder. |
---|
46 | 46 | | SECTION 3. Section 1702.283, Occupations Code, is amended |
---|
47 | 47 | | to read as follows: |
---|
48 | 48 | | Sec. 1702.283. CRUELTY TO ANIMALS. A person who has been |
---|
49 | 49 | | convicted of cruelty to animals under Section 42.09 or 42.092, |
---|
50 | 50 | | Penal Code: |
---|
51 | 51 | | (1) is ineligible for a license as a guard dog company |
---|
52 | 52 | | [or for endorsement as a dog trainer]; and |
---|
53 | 53 | | (2) may not be employed to work with dogs as a security |
---|
54 | 54 | | officer by a security services contractor or security department of |
---|
55 | 55 | | a private business that uses dogs to protect individuals or |
---|
56 | 56 | | property or to conduct investigations. |
---|
57 | 57 | | SECTION 4. Section 1702.301(d), Occupations Code, is |
---|
58 | 58 | | amended to read as follows: |
---|
59 | 59 | | (d) Endorsement as a private investigator, manager, branch |
---|
60 | 60 | | office manager, alarm systems installer, security consultant, |
---|
61 | 61 | | security salesperson, or alarm systems monitor [, or dog trainer] |
---|
62 | 62 | | expires on the second anniversary of the date of endorsement. |
---|
63 | 63 | | SECTION 5. Section 1702.225, Occupations Code, is repealed. |
---|
64 | 64 | | SECTION 6. On the effective date of this Act, an endorsement |
---|
65 | 65 | | as a dog trainer issued under Chapter 1702, Occupations Code, |
---|
66 | 66 | | expires. |
---|
67 | 67 | | SECTION 7. (a) The change in law made by this Act does not |
---|
68 | 68 | | affect the validity of a proceeding pending before a court or other |
---|
69 | 69 | | governmental entity on the effective date of this Act. |
---|
70 | 70 | | (b) An offense or other violation of law committed before |
---|
71 | 71 | | the effective date of this Act is governed by the law in effect when |
---|
72 | 72 | | the offense or violation was committed, and the former law is |
---|
73 | 73 | | continued in effect for that purpose. For purposes of this |
---|
74 | 74 | | subsection, an offense or violation was committed before the |
---|
75 | 75 | | effective date of this Act if any element of the offense or |
---|
76 | 76 | | violation occurred before that date. |
---|
77 | 77 | | SECTION 8. This Act takes effect September 1, 2015. |
