88 AN ACT
99 relating to guard dog companies and abolishing the regulation of
1010 guard dog trainers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1702.109, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 1702.109. GUARD DOG COMPANY. A person acts as a guard
1515 dog company for the purposes of this chapter if the person places,
1616 rents, or sells [, or trains] a dog used to:
1717 (1) protect an individual or property; or
1818 (2) conduct an investigation.
1919 SECTION 2. Section 1702.221(b), Occupations Code, is
2020 amended to read as follows:
2121 (b) An individual must obtain the appropriate endorsement
2222 in accordance with the requirements of this chapter and related
2323 administrative rules if the individual:
2424 (1) is employed as:
2525 (A) an alarm instructor;
2626 (B) an alarm systems installer;
2727 (C) an alarm systems monitor;
2828 (D) an electronic access control device
2929 installer;
3030 (E) a level 3 classroom or firearm instructor;
3131 (F) a locksmith;
3232 (G) [a dog trainer;
3333 [(H)] a manager or branch office manager;
3434 (H) [(I)] a noncommissioned security officer;
3535 (I) [(J)] a level 4 personal protection
3636 instructor;
3737 (J) [(K)] a private investigator;
3838 (K) [(L)] a private security consultant;
3939 (L) [(M)] a security salesperson; or
4040 (M) [(N)] an individual whose duties include
4141 performing another activity for which an endorsement is required
4242 under Subsection (e); or
4343 (2) is an owner who oversees the security-related
4444 aspects of the business, officer, partner, or shareholder of a
4545 license holder.
4646 SECTION 3. Section 1702.283, Occupations Code, is amended
4747 to read as follows:
4848 Sec. 1702.283. CRUELTY TO ANIMALS. A person who has been
4949 convicted of cruelty to animals under Section 42.09 or 42.092,
5050 Penal Code:
5151 (1) is ineligible for a license as a guard dog company
5252 [or for endorsement as a dog trainer]; and
5353 (2) may not be employed to work with dogs as a security
5454 officer by a security services contractor or security department of
5555 a private business that uses dogs to protect individuals or
5656 property or to conduct investigations.
5757 SECTION 4. Section 1702.301(d), Occupations Code, is
5858 amended to read as follows:
5959 (d) Endorsement as a private investigator, manager, branch
6060 office manager, alarm systems installer, security consultant,
6161 security salesperson, or alarm systems monitor [, or dog trainer]
6262 expires on the second anniversary of the date of endorsement.
6363 SECTION 5. Section 1702.225, Occupations Code, is repealed.
6464 SECTION 6. On the effective date of this Act, an endorsement
6565 as a dog trainer issued under Chapter 1702, Occupations Code,
6666 expires.
6767 SECTION 7. (a) The change in law made by this Act does not
6868 affect the validity of a proceeding pending before a court or other
6969 governmental entity on the effective date of this Act.
7070 (b) An offense or other violation of law committed before
7171 the effective date of this Act is governed by the law in effect when
7272 the offense or violation was committed, and the former law is
7373 continued in effect for that purpose. For purposes of this
7474 subsection, an offense or violation was committed before the
7575 effective date of this Act if any element of the offense or
7676 violation occurred before that date.
7777 SECTION 8. This Act takes effect September 1, 2015.
